When is the last date to arrive in Canada to meet PR Residency Obligation?

Hi,

I landed in Canada on June 17, 2012 and stayed there up to June 26, 2012. I never fly back to Canada since then and I manage to hold my PR Card. Now I plan to immigrate to Canada in May 2015.

My question are :
1) What date is my latest arrival date to Canada so I can meet my PR Residency Obligation (730 days)? Is there any formula that I can use?
2) Do I just need to bring my PR card to enter Canada or do I need to bring other documents?

I really appreciate your help since I plan to have some reserved-days for me to fly outside Canada if needed.

Thank you very much.

Best regards,
Abraham

1. 25/05/15 and then you must stay for 2 years without leaving Canada.
2. PR card and passport.

Hi,

Thanks for the prompt reply.

How do you calculate that date : 25/05/2015? Because I thought I still have time until 25/06/2015.
My logic is that 730 days start from 25/06/2015 till 26/05/2017.

Thank you.

You must return by June 25, 2015. And as mentioned, do not leave Canada again for any reason for 2 years after that.

While I hesitate to speak for another, I suspect a typo, that June (06) was intended not May (05).

Not sure what you mean by "My logic is that 730 days start from 25/06/2015 till 26/05/2017."

But in terms of prospective calculations of PR Residency Obligation compliance, one key date is the date you landed: June 17, 2012.

Between June 17, 2012 and June 16, 2017 you cannot be absent from Canada for more than 1095 days. This is because between those dates, to comply with the PR RO, you must be in Canada at least 730 days, and if you are absent more than 1095 days you cannot be in Canada at least that many days.

Thus, since you were last in Canada June 26, 2012, the absolute last day you can return and still be in compliance with the PR RO is June 25, 2015. Otherwise you will have been absent more than 1095 days and in breach.

Not a good idea to cut it anywhere near that close. Stuff happens. Flights get delayed. Accidents and hospitalization can interfere with travel plans. A compelling reason why it took three weeks longer to return does not offset nearly three years of not returning.

That said, for PRs still within their first five years, with a significant amount of time left before the fifth year anniversary of the date of landing, with fairly reasonable justifications for how long it has taken to actually come to Canada and settle, it appears that CBSA officers at the POE can still be somewhat flexible if not lenient . . . but there is no guarantee of that for any particular individual and generally it appears that CBSA and CIC are scrutinizing and enforcing the PR RO more strictly these days than was done in the past.
