Hello,
Please what exactly does this mean?
  • (a) for directly or indirectly misrepresenting or withholding material facts relating to a relevant matter that induces or could induce an error in the administration of this Act;

Is it a documentation problem or what, so one will know what to tackle.

The inadmissible for 5 years does it mean one is banned for 5years? Because the next paragraph says “you are welcome to reapply if you feel that you can respond to the concerns and can demonstrate that situation meets the requirements.

    Thank you

It means you either provided information/documents that were not true/genuine or you withheld information that was relevant to your application. If it’s been applied, it’s a 5 year ban. The statement that follows means if you can provide proof there was no misrepresentation, you can resubmit with the relevant information.

Thanks so much for this response.

But every documents sent was genuine and no information was withheld at all, Infact the applicant was pregnant at the time of application and was going to have the baby here before even going for studies.

How do we appeal for the ban to be lifted? When we don’t know what exactly to correct?

Did she do the medicals?

Inadmissibility with a 5-years' ban could be given if the applicant commits some misrepresentation or submits forged documents. Most commonly, we have seen such bans for not declaring previous visa refusals or for making false statements. Was this the case here?

It is a long and expensive process to appeal the decision. And, is almost guaranteed to fail.

Was the applicant issued a Procedural Fairness letter? She certainly would have been issued this letter before a final decision was taken to ban her. What were the grounds/reasons for that Procedural Fairness letter?

Yes, medical was done

There has never been visa refusal before

We didn’t receive any procedural fairness letter.

How do one go about applying for the refusal notes?

Which boxes were checked in the refusal letter?

There hasn't been any refusal before.

It was declared that she was pregnant at the time and she was going to have the baby before traveling because delivery date is far from travel date

As has been said above, if you are sure they have not been refused a visa (any visa at all) and have all the correct paperwork (all genuine), then you must order their notes to find out the real reason. But usually a ban is not taken lightly by the CIC, so are you absolutely sure they have never in their life been refused any visa or were any statements or documents untrue that were issued in the application? As if there were falsehoods...even if they were mistakes, you are wasting your money at trying to appeal it.

The refusal letter that was issued this time. The one that told you about the ban.

Did you apply on your own or did an authorized representative/an agent apply on your behalf?
