I have scoured the interent in search of an answer to this seemingly simple question.
The CIC website states the following requirements:
•be a permanent resident of Canada
•be physically present in Canada
•not be under an effective removal order
•not be a Canadian citizen or a registered Indian under the Indian Act and
•not be convicted of an offense related to the misuse of a PR card
I've looked for the definition of permanent resident and it's really confusing. It appears there's two streams to satisfy permanent residency either you've been in Canada for more than 5 years or less than 5 years - please correct me if I'm wrong but I believe:
If more than 5 years then you need to prove physical presence in Canada for at least 730 days in the past 5 years; OR
IF less than 5 years show that you will be able to meet the minimum of 730 days of physical presence in Canada at the 5 year mark.
Am I missing something, does this mean that I just need to show that I plan to be physically present in Canada for a minimum of 730 days at the 5 year mark. I must be misunderstanding something because that would seem everyone would be eligible for a PR card after arriving in Canada legally.
I arrived in Canada two years ago as a post graduate student completed my studies on a student visa and now I'm working on a work permit, which expires May 2012. I have heard mixed things such as I need to work in Canada for at least 1 year before I can apply for PR card is that true? My one year mark in terms of employment will be December 2011.
CAN SOMEONE PLEASE HELP THE ACT DOES NOT MAKE SENSE TO ME and I'm very confused about this whole thing
