HI, I'm desperate and need some advice. I have been in Canada for almost 6 years and married for 5 years. For the longest time I had to wait for all my Brazilians documents to apply for my marriage visa do during all this wait I have been extending my visitor visa. In November 2015 my husband got laid and my visa was about to get expired (December 2015) I was pregnant (unplanned pregnancy), my pregnancy had complications, I also had two little kids to take care of and we had to move about from alberta to look for other job. So, basically my visa got expired and we couldn't reaply (money matter) until after the 90 days period. I replied and got refused. Thankfully the spouse visa had the rules changed and now you can apply even if your situation is not legal. I just did that. They received my application this week (mailed). The problem is: I got family in brazil, my grandmother is very sick. I don't think she is gonna get better. She has never met my children and I would like very much to go.visit her for a month or two. But I can't afford losing my application for my spouse visa (they say I can leave the country while waiting but if for any reason I get refused to come back then I lose my application for.spouse visa) and I'm scared of leaving the country and being refused to.come back when I reaply for a visitor visa. Is there anything I can do about this?
 
There's nothing you can do to guarantee you'll be allowed back into Canada if you leave. You'll need to apply for a TRV to be able to re-enter Canada. Given you are out of status in Canada for quite some time now, I would say the chances of the TRV being refused are quite high.

If you leave, I think chances are high you won't be able to re-enter as a visitor. If this happens, you'll need to remain in Brazil and your husband will have to sponsor you outland.
 
That's what we thought :( Guess I just have to make peace with it and say my goodbyes through the phone. But thank you anyways for taking the time to answer my question.
