Visitor Status Extension with Outland PR in Progress

I have extensively researched this outstanding forum and want to confirm my understanding of the information as it relates to my specifc situation. Would appreciate confirmation or comments of my understanding!

Me: Dual citizen of U.S.A and Canada. Moved from U.S. to Canada to start new job on June 1, 2012.
Wife: Citizen of U.S.A.. She accompanied me to Canada as a visitor in June. Her 6 month visitor status expires Dec 1, 2012. We have been married for 14 years and have 3 minor children together. They are also dual citizens. They are also now in Canada.

Current status: While in Canada, in July 2012 I applied to sponsor her using "Outside of Canada" process (is this sometimes called "outland"?). CIC has approved sponsorship part. We are waiting for PR part to complete. I expect this might take until September 2013.

Goal: For my wife to remain in Canada as a visitor until PR process is complete.

My understanding: We can apply for visitor status extension and describe the reason for extension as: "desire to remain together in Canada while PR application is in process". I will include sponsorship approval letter from CIC, evidence of fees paid for sponsorship, financial support docs, marriage certificate, a letter by me stating I will support her for duration of visit, and a letter by her stating her desire to extend visit in order to complete PR process. Her letter will also say she will return to U.S. in the event the extension is denied and wait for PR process to complete.

Am I missing something? Any other advice?

Looks like your have all your ducks in a row. Only advice I can think is to apply online rather than by mail. It's faster.

Thanks for the reply. One more question. Since her visitor status expires Dec 1 and it takes CIC 30 - 90 days to approve extensions, will her situation be considered as "implied status" if she gets her extension request in before Dec 1?

If she currently has valid visitors status, then yes.

Anyone have any updates on processing times (U.S. cases) for PR's from Ottawa for outland PR applications (since Buffalo office was closed)?? (CIC website does not provide any info).

Several forum members in USA-CAN relationships were given CoPR in under 7 months recently, like as of this week. I've seen times go down since I began reading this forum and since I began collecting my PR application.

Isn't this one rare instance where slower is better?! :eek: in other words, the longer it takes CIC to process the visitor extension the better since "implied status" will be in effect. So any possibility of deportation is actually delayed in the event the extension is rejected. Only downside is that the visitor should not travel outside Canada during the implied status period. Right?

Techincally, yes. However, it's a USA-CAN couple. As long as they show funds for support (no need to work illegally) and have a clean criminal record, the VR will be approved. Immigration tends to view Americans as a small overstay risk since a) we share a huge border, and b) lifestyle is about the same. Americans aren't fleeing severe human right's issues, facing religious persecution, etc. Frankly, they're used to Canadians marrying Americans since we do share that border.

You can travel during implied status. I am still waiting on my extension/VR right now, and I am going back to the States next week. No problems at all, I even called CIC and checked. ;D

Typical information from the call centre. Once you leave Canada with visitor status (implied or otherwise) it is over. When you return, it is a new application for admission. As an aside students/workers on implied status, who leave Canada, may return, but they can neither work or attend school until they receive a new permit.

I came to Canada in February 2012 on Visit Visa for 6 months. During the visit I got Married with Canadian Citizen Girl, then I continued to staying there by extending my visit visa for another 6 months to apply for RP on behalf of my spouse.

But after 3 months of marriage we got separation from each other and my ex spouse withdrawn my Permanent Residence application.

Now I want to extend my stay for another 6 months in Canada (2nd time inside the Canada), Can you please let me know the procedure and chances of 2nd extension of visit visa..

Would be appreciated for your valuable query..

This query is behalf of my cousin.
I would assume the same way you extended it the first time. You do however, need to come up with an epic reason as to why it should be granted.

I did extension on behalf of my spouse.. but she isn't my spouse anymore... :)

I know the status is over, I called to make sure it wouldn't cause any issues if I left now (and abandoned) the extension process. Mostly, I just wasted $150, because I was thinking I would have ppr by now. My mistake, I should have just left 2 months ago.
