Hi all,

I am a British citizen living in the UK and married to a PR holder based in Canada. The PR holder has a convicted DUI (takes full responsibility) that threatens their PR status in Canada. The situation is under review by the IRCC and no judgment has been passed. My question is if I were to visit Canada within the next month, will this case have any issues for me gaining entry since we're married? As I'm sure the border officer will likely ask for my reason for visiting, and if he pulls up their record will see this pending case.

I think as a British citizen you will get much less scrutiny coming into the country. I think the case itself wont be an issue, it will be that you are married to a PR so what are the chances you will just stay in Canada. So you will need to show ties to your home country, reason for you to return.
 
Thank you for your response, I really appreciate it. This puts my mind at ease. I can definitely show ties to my home country through corporate employment, a house contract (rented though), and the rest of my family are here just not my partner. The plan is for my partner to move to the UK. Would it matter that we got married in Canada earlier this year?

The fact of when you got married wont matter, you still will have to prove you are going back. How long would your stay be? you have a return ticket?

Im not sure what others think, but the fact that she has a record she might be ineligible to sponsor you to Canada anyways. So thats another reason you can say you are going back. The plan is to move to UK as she cannot sponsor you here. That could work in your favor.

Have you looked at if the UK will allow her in? Im sure they will do background check, i know for canada having dui can make you ineligible.
 
I asked that because I don't know whether our getting married in Canada might signify that I might not go back this time, which isn't the case. My plan is to stay for 14 days and yes, there will be a return ticket.

It won't be an issue. They would only be checking your profile when you enter Canada and not your partner's.
