Greetings,

I applied for CEC on 30th jan, 2014 and got a file number in the first week of march.

my work permit expired and right now i am visitor status till 15th august,2014.

I need to travel to India due to some emergency.

What i need to know is can i apply for a visit visa from India if i want to come back or will i be asked to wait in india till i get a result on my CEC file.

If i can apply for a visit visa again from india what would be chances for approval??

to simplify it ... i am on trv right now waiting for CEC application result

What are my chances to travel with trv .. or how difficult is it to apply for a new trv from india if i want to come back

If you have your work permit valid, then you can get your TRV either here or India. However better to apply while you are in Canada as it's simple and can be applied online, but in India you have to apply through VFS.

If you don't have your work permit valid, then you won't get TRV approved. First you can apply for BOWP while in Canada and then apply for TRV.

He can't apply for BOWP as his WP has already expired.

He's asking if he can extend his Visitor Visa.

Yes you are correct and it clearly mentioned in BOWP bulletin also. But If you check through "Determine your Eligibility", it says that you may be eligible to apply for open work permit. But I am not sure what the success rate. But it's worth to try if you want to continue to stay in Canada.
 
@orgchem: How about restoring the Worker Status?

@Siddhartha: don't take this the wrong way, but was there any reason why you did not extend your WP or apply for BOWP?
Also, when did your WP expire? <- in case you want to restore your Worker Status
 
anyone who gets his/her file number can apply for an open work permit untill CIC arrives to ts decision...
Plus on top of that TRV will be issued for the same time frame as is the open work permit.... only visa posts outside canada can issue a TRV exception beiNG CPP-Ottawa

My immigration representative here in canada says i cannot apply for restoration of work status..

And as far as my work permit expiry goes .. it expired 4th january 2014 and i got my CEC file no in Feb 2014 while i was in implied status.
 
and the bowp thing .. well i had to apply for it 4 months before my work permit expired i.e .. in spetmeber 2013 and unfortunately i was completely misguided at that point of time by someone else

No, you cannot apply for restoration of work status because it has been more than 90 days since your work permit expired. If you applied to change your status to visitor, and you are now on a visitor's permit, of course if you found a job and an LMO, you could apply to change your status to worker.

To have been on implied status, you would have had to apply to extend your status as a worker before your work permit expired - it's not clear if that is what you did.

Just to be clear, the above is not correct, the rule is not "at least 4 months before the work permit expires." To apply for the BOWP, you have to apply within the 4 months before your work permit expires - if your work permit expired on January 4, 2014, then you could have applied for a BOWP from September 4 up to and including January 4, 2014. But you need to have your AOR at the same time...
 
well to be clear my work permit expired on jan 4 2014

and same day jan 2014 i was completing my required work experience for cec ..

so i applied for a work permit extension just for the sake of implied status without any extra documents and just sent the work permit application document.

and then later i applied for cec being in implied status

If you need to travel to India, and you already have a visitors permit and a TRV, then you should have no trouble returning. If you need to apply for a new TRV when you are in India, there's a chance that that it might not be approved.
