Hi

I just got refusal for my visa application just after 2 weeks since i applied. I applied in chef category. I had all the proper documents but could not provide my masters degree. My questions are ?

1. I have now got my degree from the Uni. Can i now re apply under the same application considering that capping is closed.
2. CIC office still hasnt returned my file which has my original ielts sheet and other imp documents. How do i get them back ?
3. My age will be ineligible from July and i want my son to apply in fsw category but i have shown him as dependent in my application. Will that hurt his case ?

no - if you apply again, this would be considered as a new application. You will have to wait until July 1 when the cap will reset.

This depends on the reason for your NER: it sounds like they rejected your application in the assassment stage (where the CIO assesses your points) - if so, you will not get your docs back

ur son can send a new appln with him being the PA......it won't hurt his chances.

The problem would be that he wouldn't be able to include u in his appln.....nd plz ask ur son if he is eligible to apply for a PR & scores more than or equal to 67 pts
 
You are probably feeling lousy and deflated after getting the bad news. I presume you mean you won't have enough points due to age if you were to apply again in July? Look at ALL your options and don't give up. Could you rewrite IELTS and score higher? What about trying to get a job offer and applying with an AEO or temporary work permit, then going the PNP route? There seem to be SO MANY jobs on job bank for cooks/chefs and you might actually reach Canada faster than by FSW route, there would just be a few more steps before achieving PR... All the best.

3) What did you mention in your application for your son ,a student???.....if so ,he must have to have one year experience to be eligible to apply.

Ya i mentioned him as a student as he was studying part time for the last two years. But he is also working for past two years. Now if he applies as a skilled worker will it affect his case ?
 
If you declared that your son was working and studying part time there shouldn't be any problem. He has to prove that he worked at least one full time year, or the equivalent to one full year if part time, in order to apply for FSW. Just make sure that your facts are consistent. From your remarks, it looks as if you only mentioned his part time studies. If he has all the documentation to show he was also working part time, I don't see why that would be a problem. It could be trouble if you originally said he was studying full time in that period. As you know, your son will have to complete a 10 year history and he will show how he studied and worked during that period. Good Luck.

Thanks for taking timeout to answer. I filled him as a student. I didnt mention full time or part time. I think it is understood to be fulltime to qualify as a dependent. Now because my file was deemed ineligible due to lack of education points and rejected in the same week i mailed my application, will it affect my son's chances of applying in fsw in July 2012. Do they consider old documents or look at completely new files.

Even though ur appln was rejected, ur complete information and details u provided in the appln forms will be stored in their global database. Hence, they do luk for inconsistencies in ur old and new appln

As long as the son is an adult, he is treated as a different individual and his application and disclosure intreated as such. The worst that could happen even if the dad had been inconsistent is for them to double check the sons claim. But the VO will not punish the son because of the inconsistencies or Lies of the father. So if the son qualifies, he should go ahead and apply.

Doesn't family member need to fill and sign background info ? In that case his son must have sign that too.

But again that point won't be looked in much depth if son able to provide verify able docs in support of his work and study.

Can he (son) provide full 2 years pay slips and bank statement where his part time wages getting credit ?
 
inconsistent work experience Please help!

I already completed all my documents ready for my application under FSW NOC 3215 this july 2012. Im still under the live-in caregiver prog but trying my luck under FSW category. After reviewing all my details, i just found out that I have inconsistency on my working experience. I didnt declare my work experience as medical radiation technologist of 7 years, just my caregiving experience. But I can prove that i really worked for 7 years as NOC 3215 with my pay slips & ref. letters. will my application be refused because of this? will I still pursue on applying? Im so afraid coz im aware that my work exp details is already on the database. someone pls answer this.. thanks!
 
Dera Asim, what answers have been given are almost correct.

However, you could take a chance by writing an email or letter to CIC that by mistake you forgot to attach your degree, so please reconsider your case. The chance is very less but give it a try!

Whats your education level, that will help in your FWS 2nd application too.
