Hello everyone!

I am currently completing my PR application, and I have a question concerning the validity of Police background checks: I had conducted an FBI Background Check for the US back in 2013, and a Police background check for Ecuador back in 2014. In the case of the USA, I have been back a couple of time since completing the background check, but totalling less than 2 months. For Ecuador, I haven't been back at all since I left in 2014.

Question: Can I still use these background checks for my current PR application? This would be great because I now understand that the FBI BGC process averages some 70+days for processing, especially since I am applying from abroad. Also, my Ecuadorian BGC would need to be translated, so would be great if i could use the old BCG and translation I had done back in 2014...

For the US Report, definitely NOT! Your US Police Report must be issued after the last date you were in the US, so if you've visited the US since the date the FBI issued the report, even if only for 1 day, it is invalid. My sister's first PR Application was cancelled for this reason.

For the Ecuadorian report, it technically should be valid if you haven' been back since the date it was issued. However, you might want to do some additional checks just in case. I haven't found anywhere on CIC's website where they state that PCC's can expire (they just say issued after the last time you were there), but since it is a 3 year old PCC, just do some double checking to be sure it's okay...

Thanks for the feedback! I guess I'll have to start on the FBI BGC as soon as possible then... It is definitely going to take more than 90 days to get the BCG and I already have my ITA... could it be possible for me to submit the BGC after the 90 days if I provide them with proof that I did indeed apply for one? (what would be this proof? a copy of the completed application?)

Yes, once you are one or two days from the deadline, you can submit your 'proof of application' for the FBI US PCC in lieu of the actual PCC. Generally, since CIC realizes how long it takes to get the FBI US PCC, they will (normally) grant you an extension.

'Proof of Application' includes copies of the application, the receipt showing that you mailed it to them, a print out of the delivery confirmation (if you use a mail service that has a tracking service), and also a print out of the credit card charge from the FBI, if you manage to get it before the deadline.

But don't send your eAPR until a few days before the deadline. Part of the process is showing CIC that you waited as long as you could for the PCC, before submitting your eAPR without it.
