Hello everyone, any suggestion for my situation is definitely helpful...

Applied OINP based on International Student with Job Offer
Employer Pre-screen approved
Submitted OINP application
AOR Received
Received another Email saying the application is under assessment (July 24th 2016, 2 months after I received AOR)

***My 3 year PGWP expires at October 1st 2016 (in 50 days)
I've been working at the company for 3 years and would like to keep working here.

If I do not receive the OINP Certificate in time and submit the PR application (before PGWP expire date), then I will not be eligible to apply BOWP.

***I am wondering can I apply BOWP without PR AOR using paper method so I will be in implied status after Oct 1st 2016? It will get rejected for sure. But do I qualify the implied status to keep staying and working in Canada while I am waiting for the OINP Certificate? Any consequences if I do so?

For my spouse, she is currently holding OWP which is exactly the same expiry date as mine.
If I do not get BOWP approved but I have submitted the BOWP, can she apply OWP based on my BOWP application? Or She simply need to leave Canada (or visitor visa) and wait until I starting holding BOWP?

I really appreciate any reply...

Hello xjcswan,

For International student with Job Offer, person have to submit in 2 years from graduation date.

I would like to know, have you submitted before 2 years time from graduation and waiting for Ontario Nomination from one year?
or
Have you applied after 2 years period?

Hi, thank you for your reply.
I graduated Oct 26th 2013
Submitted Application at May 2015.
The approval time for pre screen took longer than usual but it was approved March 2016.
I submitted OINP at Late April 2016.

without oinp you cant get either open or closed one. LMIA is too hard and legnthy which is not
good in your case. your wife cant get owp until your status is on open or closed wp. you can do
one thing that you wife can apply student visa and you can become her dependent, this how you will
get owp and she will b student. another way is apply visitor visa to carry one your legal status.

this is my personal view so get some more advise here. good luck.

Thanks for your reply, That what I was thinking about...but if my wife switches to student and I apply OWP based on her study permit, will this step affect my current OINP application and further (PR application)?

Should I apply the extension of work permit for same employer before my PGWP expires just so I can buy sometime to wait for the OINP approval? Or since rejection of applying extension of work is guaranteed, this will not make me qualify implied status? Or my OINP will then be affected and not get issued?

Thank you so much.

you can buy some time by apply with paper application so many guys do like this so can earn some time.
not sure about detailed oinp rules but i think if you have owp as your wife's dependent, dont think will b issue.
still ask oinp is better for confirmation. you can work on implied status until u got rejection. after rejection you will
have 90 days for status change. that period called restoration and you cant work until u can restore your status.
if you have no money issue then student visa of spouse is more safer, and if you believe you will definitely get oinp
withing risk period then just earn some time by apply work permit.

I really appreciate the suggestion.
So my steps could be:
1.Apply extension of work permit to buy some time and keep working at current company
2.If my OINP is still not approved, I stop working, let my wife apply study permit.
3.Apply OWP based on my wife's study permit
4. After I have OWP, go back to my current company and keep waiting?

I don't see this working. It's too late to obtain an approved study permit to begin classes in September. So the earliest she would be able to start classes (and you would qualify for an OWP) would be January.

you r absolutely right about this issue. well you can give best answer for this question.

My concern is the step of buying some time E.g. extension of work permit. Since I do not have AOR of PR (I did not even submit PR application since I don't have OINP certificate yet), will my application of work permit extension be considered as INCOMPLETE instead of REFUSED which means I will not have implied status?

I think you can add in your application that you are submitting work permit application assuming that by the time your file is opened you'll have the certificate, and will provide the same to cic.

Also, do you know if after getting OINP Certificate can one apply for PR from outside of Canada? Or it it compulsory to stay in Canada which will be difficult since I will be on visitor and won't have any earnings!

You can write to OINP and nicely tell them that your WP is going to expire. Nowadays, OINP gives faster processing time for people with near expiring work permit. At the same time, you have to prepare all documents to apply for PR when the nomination comes immediately.
