Yes we do have IrCC certified copies of all of our old passport which was surrender to IrCC and now after becoming protected person we applied to RTD ( passport)

I applied in October my kids study permits but no response from IrCC , many consultants says they are minors they don’t need study permit as they are going school since 2023 start.

Now in grade 2 & 4.

Technically they don’t need study permits although some school districts are becoming more strict and asking for proof of study permits. We are also seeing this for children of study or work permit holders who are between 4-18. Technically a TRV should be enough to attend primary or secondary school but some visa officers are insisting that the children apply for SPs. More school districts are also wanting proof of SPs for children to ensure that foreign nationals are entitled to “free” public education. As processing times for PR or time as a temporary resident has increased children having more than a TRV can be helpful.

School did not ask for any status as we are protected persons.

My questions was about USA embassy will allow us to be interviewed with RTD and what documents we can carry for kids if we don’t have their study permits

if your children;
Minors, Living in Canada, attending elementary or secondary school (K–12), and at least one parent is legally allowed to be in Canada
They do NOT need a study permit to attend school. https://www.canada.ca/en/immigratio...nada/study-permit/prepare/minor-children.html this is explainable, normal, and not a red flag if you explain it clearly and calmly, if there is question arise.

Although legally possible we are seeing more schools asking for proof of SPs and starting a few years ago we started seeing more VOs insisting that children between 4-18 apply for study permits versus just a TRV. It is also helpful to have a study permit where the expiry date is automatically tied to expiry date of their parent’s temporary status. That is not guaranteed when it comes to visit length. You can ask for visit length to be more than 6 months but many are stuck regularly applying for visitor records. Children having a study permit makes many things easier.
