Hello

I have appointments with my kids to US embassy for visitor visa interviews

They asked to bring passport we base RTD which is okay? Rite


They asked to bringing status in Canada documents we adults has Open Workpermit and Refugee claimant docs BUT for kids we just have Refugee Claimant docs it is okay as they are under 10year of age has no study permits ?? But go in regular school from last 3 years ??

Please advice need advice which documents can be presented at embassy for their status in Canada?? Other than RTD

Yes there is no issue bringing their home country passports to prove their identities but would not use it for any other purpose.

Your children should really be securing study permits. You can only show what you have.

No kids are minor they don’t hold any study permits they have only
Refused travel documents ( passport) and refugee claimant IrCC paper.

For us we hold only as passport ( refugee travel documents) as we surrender our own country passport to IrCC while refugee case submitted.

As far as I know you can not ask for visa if tou are refugee claimant.
You must be a protected person, that means you had your hearing and are acepted. After accepted you can request for a refugee travel document and with that document you can request the visa, the interview.

How are you applying without a passport? Because for claim asylum you must give your home country passport.

Maybe I understand wrong what you explained but it is true that as you are a refugee claimant you cannot leave the country until you have an answer to your claim.

No dear we are protected person our refugee case was approved 1 year ago and we gets RTD after become protected person.

Now we have RTD on which we applied on that basis ( as that RTD is our passport ).

We husband wife has open Workpermits and kids has no other documents to show their status in Canada Except RTD and their claimant paper .

We we good to go for USA embassy for visa interview

I applied and they refused. Said not sure if I will leave the country ( **/ what!!) .

But you try to show you are settled here. Payment stubs or a letter from your employer.
If you have savings , show bank statements.

What they want to be sure is that you will leave at the end of your visit.

For your children bring the certified copy of the passports. Dont show your hone country passport. You are not supposed to use them anymore as you are protected person.

Being your decision letter. That is important.

Parents has open Work-permits

The document that shows your status is your notice of decision. For our status, the work permit doesn't show status.

You should have your and your children RTD which is proof of your status in Canada along with your acceptance letter in which all your children status mention, for you and the other adult(s), bring your open work permit as proof of your status. For your children under 18 for the purpose of the U.S. interview, their refugee claimant document itself usually suffices as proof of legal status ( I presume).

Thanks, i have main concerns about kids status in Canada what to show to embassy as I can show RTD and Notice of decision as protected person all members. What else I can take with me for kids under 10yeara of age

They are actually entitled to apply for study permits. They aren’t needed to enrol in primary or secondary school in Canada but US may want more proof they have status. What was once possible is no longer possible in the US so tough to anticipate what they will accept or whether they will grant visitor visas for protected people, especially those without PR, these days. All you can do is provide what you have. I said that you can show your passports if necessary for ID purposes if it is required but agree that a photocopy would be best to be safe.

Yes we do have IrCC certified copies of all of our old passport which was surrender to IrCC and now after becoming protected person we applied to RTD ( passport)

I applied in October my kids study permits but no response from IrCC , many consultants says they are minors they don’t need study permit as they are going school since 2023 start.

Now in grade 2 & 4.

if your children;
Minors, Living in Canada, attending elementary or secondary school (K–12), and at least one parent is legally allowed to be in Canada
They do NOT need a study permit to attend school. https://www.canada.ca/en/immigratio...nada/study-permit/prepare/minor-children.html this is explainable, normal, and not a red flag if you explain it clearly and calmly, if there is question arise.
