Hi all, My extension of open work permit is rejected. I have received the medical exam request for my CEC and the result is mailed out today. Should I just apply for a temporary resident visa and stay till I finalize my CEC? Should I depart Canada and apply a Visa outside Canada? How long it will takes to get my PR after medical exam nowadays? My work permit is expired already.
It is not possible for my to apply the work permit again since my landlord doesn't want to do the LMO. But they gave good reference for my CEC app when CIC called for reference.
 
No one knows for sure but it's been taking around 1-2 months after medical results are received... sometimes quicker sometimes slower.

Why was the open work permit refused?
 
CIC request the LMO.
But my employer seems don't want to do that. They asked my to apply again with my CEC acknowledge letter. Then it got rejected.
I am thinking to request a temporary resident visa. But I don't want to loss my job.

My problem is my work permit is already expired. So it won't meet "•it is confirmed that the applicant currently holds a valid WP that will expire within the next 4 months and there are no other issues of concern. "
So do you think I should apply for temporary resident? Or should I depart Canada to apply?
In the medical exam form CIC sent me, they mentioned that I should not quit the job or leave the country. But that for the CEC application. I really don't know what should I do.
 
1. You MUST stop working immediately as you no longer have implied status. If you don't and CIC finds out, you may be asked to leave Canada and your CEC application may be rejected too for working illegally.

2. You now have 90 days from the date of work permit refusal to apply for restoration of your status AND to change the conditions of your stay to visitor(i.e applying for a temporary resident visa as a visitor). Note that visitors are not permitted to work.

Be sure to explain properly how you lost your status and why you are applying for restoration - you can say that you've applied for PR under CEC and received a medical request(attach a copy of the medical request email you received) and would like to remain in Canada until you hear from your visa office.

***Submit proof of adequate funds to support yourself for the next 3 to 6 months at least. If the visa officer is not satisfied that you can support yourself, then he/she may be worried about you working illegally and could reject the application, after which you will have to return to your home country and wait for the outcome of your CEC application from there.

I think you are right. Do you think at least I can stay in Canada, if I apply the temporary resident now. I will stop work from Monday.
 
I don't know what a visa officer will do. However, if you would like to stay in Canada legally, you have to take the necessary steps and hope for the best. :)
 
for safe side and according to new rules pay 150 dollar and send open work permit application ...so u still iligible / legal to stay in canada / after medical with in 1 month or maximum 1 month and half u should et ppr / good luck and be patience everything will be fine / if u listen and follow me fil the the form for open work permit and pay 150 dollar and send it right a way ....
 
When did you apply for your Open WP?? I would try to get a visitor visa, it seems you are on the last steps to get the PR.
