Urgent : I GOT THE PR

Hello all

I have got my PR last month and I am going to get married in January 2016.
How will my spouse get PR?
How much time will it take?
What is the best process we should follow to get her PR asap?

Is there any way my spouse get PR within 2 3 months after we get married?
Or is it possible to get Work Permit for her so that she can accompany me and continue her career there.
Waiting for 12-24 months will hamper her career if she accompany me on visitor visa too.

I am about to get married in Jan'16.
So couldnt include her that time..

I have not landed yet. I am in India. Will be going in November just for applying PR card. So, practically, after wedding I will be in India only. She will also be in India.
She is an Indian only.

I am planning to take her along with me only with working rights.

Please guide. In dilemma.

I am new to all this.

2-3 months would be very fast, I would expect a lot longer, at least 6 months.

Prepare as much information as you can before getting married, so all you need is to add a copy of your marriage certificate and send it in.

Are you planning on applying outland or indland, and at what visa office?

Hey,

The current full processing time is 17 months or 8-10 months for straight forward cases from the time it reaches Delhi and this excludes the 60 days for the first stage for approval of the sponsor and there isn't a way to get it in 2-3 months and no ASAP method. You apply and wait in the queue.

She cannot apply for a dependant visa since you are a PR and only permit holders such a study permit or work permit can sponsor that way
You can apply for visit visa for her but she has to show ties for her to get the TRV since she is working it wont be a problem

Your biggest concern should be not the wait but ALL PR applicants should be in the country to sponsor a spouse from outside the country, so basically as a PR you have to be in Canada to apply for your wife and only Canadian citizens can sponsor while being outside.

The only way for this to happen would be if she got a visitor visa and you applied inland once she arrived, only inland applicants can get a work permit. The downside to this method is that the processing time is long and she would not be able to leave Canada until PR is approved. You should also note that once one has a Canadian spouse it is quite difficult to obtain a visitor visa.

The only way you will be able to live together and work together is if your wife is able to secure a full time job in Canada and her employer is able to get an approved LMIA so that she can get a closed work permit. Then she can come to Canada to live and work while you process the PR application. Otherwise there will be a period of time where you are either separated (if you apply for PR while she continues working in her home country) or where she is unable to work (if she comes to Canada on a tourist visa and then you apply for PR while she is here).

What you can try to do is have her apply for a TRV and if approved, come to Canada once you are married. If she's able to do that, you will be able to sponsor her using the inland process and she will be able to obtain a work permit four months after the application is submitted. If the TRV is not approved, she will have to remain in her home country while you sponsor her from within Canada.

TRV is temporary resident visa = visit visa.

Every couple who applies has been through the same situation I am not sure what other insights you are looking for - we have clearly spelt out all the available options. There is no ASAP method and all you can do is apply, take a token and wait in queue of course you can apply for visit visa which you might have a better option than apply for work permit since its much harder.

I feel the best option is for her to continue working while waiting out the processing time; come here on a visit visa and not work or apply inland which is not recommended.

She is a chartered accountant and working with one of the big 4's.

I just want 1 thng..that we go togther and stay togthr since start.

Yes - it will most likely be extremely difficult. Most employers aren't willing to go through the LMIA process because of the time and money it takes. As part of this process, employer have to advertise the job for at least a month to prove no Canadian could be found for the role. Canada has plenty of chartered accountants - so most likely this will be something that is difficult to prove. Having said that, she can certainly try. Don't bother with any of Canada's big five banks - they don't to LMIAs.

all she can do is ask her manager or HR if the company is willing to do what is necessary to make an internal transfer possible.
