Urgent Help Required - Visa Expiring at the exact end of one Year

Dear Team Members,

I need your urgent help. I came to Canada on ICT work permit and my visa is expiring in Aug (1 year after I came here). Now I become eligible for CEC on the same day my WP gets expired. My organization has agreed to apply for extension but I wont be getting it in August as it take 3 months for processing.

So effectively I would be working legally after my ICT expires i.e. in Sept but I wont have any work permit.

Can I apply for the PR in parallel and give a justification letter that my company has filed for an extension which I am waiting for and hence do not have any official document to show a valid work permit.

The reason why I dont want to wait till I get the extension is the cap issue...I want to make sure that I apply as soon as my one year gets over....

You will be on implied status, so yes, your work is authorized, and yes, you can apply any time after you qualify (though I generally recommend giving yourself a cushion of a couple of weeks). I believe CIC can see in the system that a new work permit has been applied for, but it won't hurt to include a written note that your company has applied for the new work permit, and the date of application.

Thanks a lot....I agree with you that giving a cushion of couple of weeks sounds good...but I am running against time...so will apply the next day i complete one year...Have calculated the number of hours and it comes to around 2000 as I work 40 hours a week and this is what my company would also write in the reference letter...

If you work full-time (more than 30 hours per week, total hours are irrelevant, you just need 52 weeks (at a minimum).

And just a caution - unless you started working on the exact first day of your work permit (which would be highly unlikely), then you would not qualify at the expiry of your 1 year work permit. You have to calculate the one year from your first day on the job....

I think I have become very cautious after reading blogs on this forum...

Do you know I manually counted the weeks and they are coming to be exact 52 on the second last day of my WP expiry...

My WP started on a Friday and I started working on MOnday and it expires on Saturday and I am working till Friday...Hence exact 52 weeks - Hurray.....and since I worked 40 hours a week its almost close 2000hrs - removing the bank holidays (but I know it doesnt make a difference as anything above 30 a week is good)....

well, that's great! but in any case, you can relax a little bit since your employer is applying for the extension (hopefully that won't be derailed by the recent program changes...). And remember, your letter of employment must be dated AFTER you complete the one year...

Thanks Jes_ON and as you mentioned in another thread..I will wait for extra 2 - 3 weeks (as my employer would have filed my extension and I would be on implied status) before I file the application and I will make sure that the date on the reference letter is appropriately mentioned...
