Hi guys,

I need your help in this situation. I have been sponsored by my wife under spousal category and we live together in canada since our marriage. I am on a study permit. We went for the interview to LA last week. Good news is I have been approved but the thing is visa officer told me to remain in status until my application is finalized and they issue me PR. My study permit is expiring next month i.e. end of august. I won't be able to extend my study permit because I couldn't continue my study after our marriage because of raised expenses. Now what are options to apply for and how much are the chance of being it approved.

please help and share your experience.

Apply for a visitor permit. Application to change conditions to extend your stay in Canada. I think it is $75.00. I don't know how long they are taking now to process but it doesn't matter. As long as you apply for it prior to running out of status, you have "implied status" and they will likely give you a year on the visitor visa. Make sure you write down that your student visa is expiring and that you cannot renew it and that your spouse is sponsoring you and provide them with a copy of any document that the CIC has given you such as the AOR or approval for your wife's sponsorship of you. Don't allow your status to run out no matter what anybody tells you. The CIC does not like this.

thanks Kiwi12 for your reply, I was thinking this option but I heard for visitor visa there are not much chances of being it approved because they know intentions are not to go back to home country.

You're in a different case. If you were in India, applying for a visa to come and visit your spouse, then most likely it will be denied. But you are already in Canada, and you're at the end of the process. You have applied for PR, so it is clear that you will be staying in Canada, it's only to "bridge" until your PR comes through. If you follow the advice from Kiwi12, you will most likely get your study permit changed into a visitor visa without issues. Also - as mentioned - as long as you send the application to change your status before the current one expires, you can stay in the country under implied status. So if you're lucky, by the time they answer back to you regarding your change of status, your PR will have come through and you won't need it. It's a good way to make sure that you stay in status.

Thanks Sweden for the reply, I will definitely do the way you guys suggest in couple of days and I am gonna do it via paper based application as it takes longer to process and will give me more time. My lawyer is asking for $750 to do this. but I know this forum will save me those dollars.

that's a rip off - the fee for the extension is $75 and even if it requires a little paperwork, it's really nothing, so you're better off doing it by yourself, especially that it doesn't seem to be a complicated case.

Hi sweden, can you tell me the exact form for this. Is it gonna form extend your stay as student or extend your stay as visitor( this forms guide says it is for people who already have visitor visa). can you clarify?
