Hi,

I would like to know if I can apply for a study permit even though I am under a removal order and it is stayed. Basically my removal order which cannot be executed by reason of a statutory because of my pending appeal before the IAD.

Your help will be appreciated.

You can certainly try applying for a study permit - however chances are likely very high it will be refused.

To be approved for a study permit you must prove that you have strong ties to your home country and have no plans on remaining in Canada long term. I suspect this will be difficult to prove if you are currently in Canada and also under a removal order.

Having said that, you can certainly give it a try. Note that you must be accepted by a school in Canada first before you can apply for the study permit. Make sure the course you take makes sense in light of your past education and experience. Also, you will need to show that you have sufficient funds to pay for your studies (this means showing a bank balance that includes funds to cover first year tuition + $10K in living expenses). Note that you will be paying foreign student tuition fees (not domestic fees).
