Dear gents,

I received today two letter from CIC.

In the 1st one they asked me to pay for Right of Permanent Residence Fee. Done.

In the 2nd letter they have sent medical request for my son who is not accompanying me to Canada, because he stays with my ex-wife. All my attempts to convince his mother to conduct his medical exam were unsuccessful. Instead I included in my application form :

1. Notarized Statutory Declaration, in which I stated my understanding that without medical exam my son would be excluded forever from family class sponsorship and I would never be able to sponsor him.
2. Notarized translation of the court decision stating that our son stays under his mother custody, while I am in obligation to pay monthly alimony to her.

But still, I received that letter, asking me to have medical exam for my son to proceed further with my application. As usually I need your advice, what would you recommend me to do now?

I guess since you are paying a monthly alimony to her, they are asking for the medicals.
Try and sort this out with your ex or try means of how you can get a medical done.
Does the custody documents mention sole custody?

Hi

IRCC doesn't like to exclude dependent children, so they will often push applicants to get the medical. Respond and refer IRCC back to the documents you already submitted, along with a letter of explanation detailing the efforts you made to get his medical done. If you have photocopies of the notarized docs, include them. If you have any proof of communication with your ex about her refusal, include that too.
