Unaccompanying Parent form

Hi I have applied for permanent residency ror me and my son and asked to submit proof of separation as well as for my husband to submit and sign a form of unaccompanying parent.

I have full legal custody of our son. If my husband refuses to sign the form can the judicial separation that shows my legal custody work?
