[Ottawa – July 23, 2013] Shortly before today's noon deadline, PAFSO received a letter from the President of the Treasury Board responding to our offer of binding arbitration.
As he has stated publicly, Minister Clement has agreed to PAFSO's offer of binding arbitration subject to “certain conditions”. PAFSO is reviewing these conditions and will follow up directly with the Treasury Board. PAFSO will need to assure itself that any arbitration mechanism allows for a full and fair hearing of arguments on both sides – an objective we are sure the Government shares.
PAFSO appreciates the Government's attempt at finding a resolution to this dispute and remains hopeful that a responsible way forward can be agreed upon by both parties. Until agreement is reached, there will be no change in PAFSO's job action measures.
PAFSO will update our members, the general public, and the media once we have more information to share.

PAFSO Responds to Government's Rejection of Arbitration

[Ottawa – July 26, 2013] Shortly before noon today, PAFSO received a letter from the President of the Treasury Board in which he rejected our offer of binding arbitration. Minister Clement’s decision was based on the grounds that PAFSO would not accept all six of the preconditions he wanted to impose on the arbitration process.

The Canadian public must understand two key facts:

1. Two of Treasury Board’s preconditions were so paralyzing that their acceptance would have predetermined the outcome of arbitration in the Government’s favour and negated the purpose and integrity of the process. Specifically, they wanted to exclude from consideration any mention of other professional groups in government who perform the same work as us – often in neighbouring offices – which has been at the heart of our position since day one.

2. PAFSO made a reasonable and responsible effort at finding common ground by accepting two of the six preconditions, and committing to a goodwill gesture – a suspension of service withdrawals while arbitration is ongoing – which would have satisfied a third.

Let us be clear: PAFSO has not rejected binding arbitration. We offered it in the first place. We agreed to pursue it even with three of Treasury Board’s preconditions. This offer still stands.

If Minister Clement truly believes his offer is “fair and reasonable”, he would not have shied away from arbitration without preconditions. Rather, he would have welcomed the opportunity to submit his offer to independent scrutiny. Instead, he sought to stack the deck in his favour by cherry-picking criteria which would have favoured Treasury Board’s position. He is trying to tilt the playing field to the Government’s advantage, and is clearly uninterested in a fair contest.

The Government has reached tentative agreements in two other long-outstanding contract negotiations during the last month, and will return to the table on Monday to address a third. PAFSO is one of the smallest unions in the federal government. Equal pay for our members could be achieved for $4.2 million – 1.5% of the impact this strike is having on the tourism sector alone. PAFSO can only conclude that the Government is behaving prejudicially toward the Foreign Service and is therefore negotiating in bad faith. This should be of serious concern to all Canadians.

Effective Monday, in order to persuade the Government that binding arbitration remains the responsible way forward to resolve our dispute, PAFSO members will withdraw all services until further notice at Canada’s fifteen largest visa processing centres abroad: Abu Dhabi, Ankara, Beijing, Cairo, Delhi/Chandigarh, Hong Kong, London, Manila, Mexico City, Moscow, Paris, Riyadh, Sao Paulo, and Shanghai.

We take no pleasure whatsoever in these strike actions and their real, severe, and mounting effects on the Canadian economy. But it should now be evident to all Canadians that from this point forward the Government of Canada bears sole and complete responsibility for these impacts. PAFSO encourages all individuals, businesses, and industry associations with a stake in the outcome of our dispute to intervene with the Government and urge them to bargain freely and flexibly with their own employees.

Guys i can feel your agony, this waiting game costs me earnings in my job abroad, now i decided its time to move on after 7 months of lost income, i easily borrowed my passport as long as you have a valid reason. Now i have more sense of relief kasi i easily get back to my company for my rotational work abroad for few months while waiting, all ready to flight na. Believe me there is no much activities going on sa embassy and now they are closing services is even worse, i have to wait 4 hours before they release my passport, talagang hinanap pa eh (dec applicants ako)sa baul. Eventually our sufferings will end, the strike will come to an end and wi will be rewarded with a visa if its God's will, if not its not meant to be. Ok lang kahit anong decision sakin as long as di magsusuffer family ko, kasi even if i get my visa we still have to wait kong kailan kami idedeploy ng agency depende raw sa project ng employer, others with my same job position may visa na since november pero di pa nakakaalis...

i was terminated from my job in UAE when they have to know that im applying for a visa in Canada, they didnt continue the processing of my residence visa kase aalis rin naman daw ako and i needed to fly back home to pursue my Canada application. Actually we can always pull out our passport kasi right natin yun eh kasi important documents yan, its a common situation yan sa embassy kasi because of long delay, write down niyo lang po amg reason niyo, and this wont affect your application sabi sakin ng staff dun kasi pag yung papers mo na ang nireview they contact you naman and request for your passport kapag approve ka, dont totally quit mam. I understand kasi may family tayo support, just like in my case di sapat sa budget ko ang temporary job ko dito, kaya case to case basis yung iba kaya nilang magwait eh. Kaya lang in your case May lang pala kayo nagpasa medyo kailan lang pa naman, eh sabi niyo di na kayo pede sa old job niyo sa UAE , sayang naman, kasi ako i can always come back sa job ko. More patience pa siguro mam but talagang yung Nov and Dec kami di pa maprocess. Lets hope for the best...

Thank you sa moral support. TWP po ang application ko. Maybe ill wait for another month, kase yun mga kasabay ko sa May nakaraceive ng MR nila after 65-72 days. mine will be 75 days sa aug5, so hopefully maka-receive ako ng MR by that time. if not, naapektuhan na talaga ang service ng CEM. Hoping for positive updates. Goodluck sten lahat.

Lalo naman nakaka depress ang mga nangyayari to the point na withdraw na ang mga passport naten...

Actually, nagiisip na ako ng ibang options plan B... Kasi naka hang lahat ng docs naten sa pagiintay at ang huling hatol sa resulta ng visa."... Nagguluhan din ako king anu ba ang dapat... May work ako Dito sa pinas kusinera ako pero waitress apply ko sa canada... Pangalawang contrata ko na ito sa restaurant sa pinas mag end of contract na ako sa november... Siguro intayin ko na lang matapos contrata ko sa november this year saka na ako magdecided kung ano ba ang dapat... Kung may proceso pa ba nagyayari sa mga application naten at kung may kahihinatnan ang sobrang mega tagal na pagiintay na ito...

December 21 2012 naipasa documents ko sa canadian embassy
February 14 ako ngapamedical sa st.lukes..
March 11 naipasa ng st.lukes ang medical result sa canadian embassy..

Mag 8months na ako sa august 21 2013 since naipasa all my original docs and original passport.
Mag 5months na ako sa ausgust 11 2013 since naipasa ang medical ko sa embassy..
magiisang taon na po sa december ...

and i still waiting for a possitive result madugo at matyagang pagiintay..

Lahat tau mga kapatid na pilipino ay sabay sabay na magdasal sa ating nagiisang panginoon na malampasan naten ang lahat ng pagsubok at matapos na ang strike na ito masettle na.. Huwag hayaan ng gobyerno ng canada na ganito at mangyari magkaroon tayo ng exemption at magdatingan lahat ng visa in GodsTime.... Lord have mercy on us... godbless us... Thank you Lord..

yes personal mong irequest sa embassy meron silang form sa reception palang sa baba, ask ka kung anong purpose mo and they knew it yung sa reception they will write in the form," pull out passport "write mo lang yung reason mo sa request form.
