The baby can come back whenever he/she wants but if the parents aren't PRs or citizens or have work/study permits they can't just come back whenever they want or stay as long as they want. Have they also paid their hospital bill? That would factor into whether the whole family can return. They should also be applying for a passport. Are the parents US citizens or from a visa exempt country?
