Tourist Visa Extension

First, apologies if this has been asked in some way.

My partner and i have neen together for almost 3 years living overseas together for most of this time off and on. I am a Canadian citizen and returned to Canada this year. My partner recently joined me and she was originally granted a multi-entry tourist visa from the Canadian embassy in Peru, which will expire next month. In the preceding 6 months we were married in Canafa and she is now my wife. We are going to submit a Spousal Visa application next month, but my understanding is that we still need to submit a TV extension application in the interim. This means we need to submit a visa extension application at least 30 days prior to expiration (ie this month).

My questions are as follows:
1. Could there be an issue of approving the extension as she is now my wife?
2. We have the marriage document from City Hall signed by the CoO and witnesses, but the actual certificate has yet to arrive. Would it likely be ok to submit the City Hall document or will they ask for the certificate?
3. As this is an extension, do I still need to provide a statement that I will support her during her stay and provide proof of financial means? Does the statement need to be notarized?
4. The extension application asks for an amount of funds that the applicant has. Since I am supporting her, not sure what to put here as she does not have funds as she is not working.

Not really

Yes.

Funds you can prove that you have. She can not work as she does not have work permit

Please also note the following:

With an Application to Sponsor (InLand) http://www.cic.gc.ca/english/information/applications/spouse.asp your wife will have an implied status and will be allowed to stay in Canada as visitor.

From CIC website:
Maintaining legal status

Spouses and common‑law partners of Canadian citizens and permanent residents in Canada who wish to apply for permanent resident status are no longer required to have legal immigration status provided that they have an eligible sponsor. All other eligibility requirements continue to apply.

*It will be best if you submit your application prior to expiration of your wife's visitor visa. Also note that when you submit an Application to Sponsor (Inland), it is recommended that your wife does not travel outside Canada because this is one of the requirements of Inland applications that sponsored person stays in Canada for the entire duration of processing. If she travels outside Canada, she can be denied re-entry.

We were planning on applying Outland to her home country in Peru. Thus, do we still need to apply for a visa extension? If so and we have not yet submitted the application, what reason should we state as wanting to extend her visit, given that we got married in Canada. Or maybe best to submit the Outland application at the same time as the visitor extension?

Yes, for her to continue to stay in Canada legally a valid visa or extension of visa is required

If so and we have not yet submitted the application, what reason should we state as wanting to extend her visit, given that we got married in Canada. Or maybe best to submit the Outland application at the same time as the visitor extension?

You need to apply for extension of visa 30 days before expiration

I am a bit concerned that if we mark married and asking for an extension of a visit, then it will be denied because we are married and thus does not really appear to be visiting?

Should we state that we will be applying for PR on the extension application or mark the purpose is visit.

Can you apply for visa extension along with Outland PR or is this only for Inland PR.

Just looking for best possible approach.

If you can, including proof of your pending PR application. Best proof is a copy of the receipt if by mail or give them receipt # in an online application. You can pay ahead of time if your application isn't ready yet. It will show CIC you're serious.... but, yes, there's always a chance she will be denied.

Hi again,

Just completing the application and have a couple of questions as follows:

1. Funds available for my stay - As per the original visa, I am completely financially supporting my wife stay during her time in Canada, she does not have any funds. Any suggestions on how to complete? This section needs a $ value.
2. Her original purpose of the visit was Tourism. Should I select this as the purpose of the visa extension. I have noted in a cover letter that we have applied for Family Sponsorship and will provide proof of payment as such.

Sorry, lastly, I am providing the following to accompany the application:

Notarized affidavit of support, financially and medically
Offer letter of employment (dated May 2012) and last 2 pay stubs
proof of joint bank account
civil marriage document (certificate not yet arrived)
photos of wedding and copies of marriage congrats cards
receipt of application of PR.

Anything else of suggestion?
