Just got married and anxious to begin the process...there are a lot of barriers in the way currently. I'm a US Citizen and he's a Canadian citizen, he has to get his child support out of arrears from when he was out of work. We are thinking of hiring an Immigration lawyer but aren't sure if it is necessary or even helpful? I would much rather be living with him in Canada while waiting for the processing to complete but know that after 6 months I'll have to leave. I am trying to understand that if I am 'visiting' him in Canada that I can still apply and have my application processed in Buffalo? (which is where mine would go as I'm from PA). I was hoping to go at the end of this year and spend 6 months (the allowable time for a visit before they give ya the boot) living with him while we file our paperwork and finally get to enjoy being married...

Any advice?

Hi there! Congrats on getting married! I wouldnt waste your money on an immigration lawyer if your case isnt very complicated. You can get a lot of help here! :)
Yes, you can visit him in Canada for upto 6 months. If he can get his child support out of arrears by then, and you send in your application for PR and have the receipts for it, you can extend your visit by sending in $75 along with the proper paper work by your 5th month of visiting, requesting to extend your stay so you can continue visiting your husband while your PR is in process (and submit all the proof you can that it is processing, such as the receipts for sponsorship and PR app, and if you have it already - your sponsorship approval , along with your birth certificate, and a letter from your husband along with proof of his income that he will be financially supporting you while you are visiting. It takes a few months to get the approval back (as of right now), but during that waiting time you are on implied status, and you can continue visiting until you get a decision back.

And yes, you can file outland through Buffalo while you are visiting him in Canada. We are doing that right now - my spouse has been here for over 19 months now on an extended visitor visa.

Just when you cross to visit him, make sure you dont say you are living with him for 6 months, make it clear that you know its strictly a visit.
 
You are awesome Tiggilicious! I was just getting ready to ask a very similar question and you have answered it beautifully. I have been in Calgary with my hubby since the 10th of June and I want to extend and wait out the process. We are headed to the border to get student visas for my two sons and I want to try and get an extension there. Do you think they will do it at the border or should I just send in the paperwork like you suggested?

We've been together for four years and I'm trying to find out if out of arrears means paid off or simply that he is making his payments (including backpayments). It could be complicated given the child support situation Not sure if anyone has had this problem before?


So if I cross and they ask how long I am visiting I'm just supposed to make it clear that I'm visiting and not living there? I suppose I also shouldn't mention that I'm going to be filing for PR once his sponsorship application is approved? Do I file for my vistitation visa before I go or do I do it while I'm there (like you said in the 5th month)?

Sorry for all of the questions but there was so much I didn't know before looking through this and it's all so mind boggling!
 
Hello all!

Quick update! Just received our passports back from Buffalo! The wife and I were painting our front room when the door bell rang and our postal carrier was at the door. I knew what it was right away.

July 20 - I received PPR
July 25 - I mailed our passports to Buffalo with requested photos of me and my family members via FedEx
July 26 - My Passports received in Buffalo
Aug 07 - Received our passports back via the prepaid USPS envelope, mine with my new visa applied!

So thrilled to be planning a landing date! Hopefully our home sells as soon as we list and we'll be good to go!

hopefullysoon, you send the application for sponsorship and PR all together, it gets sent to Mississauga where they process the sponsorship part and make sure everything is signed and everything is there, then once approved it's sent to buffalo where they process the PR part.

As far as the visiting visa part, you tell them you're visiting, they'll ask how long or when you plan on returning and based on what you tell them and evidence such as proof that you applied, your husband was approved as a sponsor, how much money you have saved to provide for yourself, they then issue you a visa for how long they want, it's not always 6 months. but once in Canada you can apply for the extension when its time too.
