Your lawyer is right by saying he has dealt with cases immigrating from US.
You technically would immigrate from India, so confirm how he plans to send the PP to india..
The PPR will come to the lawyer in Canada..how will the PP reach India is the question.

Doesn't matter how you send the PP to Delhi, how do you expect ND to send you the
PP back with Visa?
You are right. I already know that if I would have to travel to India for the Interview for sure, but didn't realize the part where ND needs the passport. FML!

Yeah my case is a bit complicated. 8
I do hope they process mine in ND and not the US, it takes a year to get it processed from
The US, no joke, even says it on their website, so ND applicants are lucky to have their processing time 6 months or less.

1. ND does not work by common sence, and if they find out that you live in US and your PP is in India..well, that is a complete different story of what can happen next.

First of all, i think you got everything all confused.

You can select processing office as US IF You have lived in US legally for more than 1 year...on a proper visa.
Having said this, it is completely CIC's decision to accept this request or send your File to ND as you are an Indian citizen.
Chances are they will send it to ND for processing.

Moreover further to what fprince advised you.... I had kinda same situation may be bit different... I am permanent Australian resident.. I marked on application forms that i wanted file to go through sydney australia... After sponsorship approval, file went to sydney.... sydney kept file for two months and sent it to ND India stating because I am Indian citizen ,file would have to go through New Delhi office..

Also having a representative is pain in @rs... I had canadian rep (which i have kicked out now)...it will waste a lot of time to get PPR cuz of transit time from India to Canada....

And good luck with passport thingy as its very tricky as fprince said u can be still called for interview even when they have ur passport.. then how will u travel to india??

So make sure you do look at these points before proceeding as they are very important aspects not to be ignored. :)

So you are living in Sydney then? How did you get your passport to the ND office? or did you go back
To India until this entire process is over?

He went back to India ..its more complicated than u think.
Don trust lawyers on this issue, they do not have a clue abt the Indian Govt and their rules.

Your best bet is to travel to India when you get the PPR through the lawyer in Canada.
Stay in India until the PR is done and the PP returned to you.
This is the simple way out...no idea abt how you can physically reside in US and send the PP to India somehow.

That also makes you illegal in US if for some reason you are checked.
You will not have a US Visa as it will be in the PP which will somehow be in India..
too much confusion if $hit was to happen

It makes sense. I will speak to my mom
About this and see what she says. I know that she is scared to send me
To India on my own.
Even if they do have my PAssport, it won't make me illegal in the US, I'm here on a basis of a work permit (but again, that's a different topic). But I just can't seem to get over the fact now that they could still call you in for an Interview, if they have your passport.

Every applicant on this thread who had an interview..around 20 of whom i know off here, had a interview after a PPR.
