Hello everyone i hope someone could grant me some good advice on my situation .

My girlfriend and i have been together since 8 years , she is now in canada living there since september 2012 as a permenant resident and she works there in a restaurant , we are planning to marry on christmas and i have been granted a visitor visa for 5 years .

After we marry in christmas in Canada i will leave back to my country and finish some work related issues back there and then iam planning to get back to canada to live with her on april 2014 .

Do u think that the officer would grant me entry again in to canada on april?
Do u advice me to file for PR from inland canada after my marriage or after my second entry ?
Can i file for PR from my country after marriage and get to canada in april without any suspicion ?

Please i need an advice on my situation and do not hesitate on giving any idea outside the questions i posted .

I hope you didn't live together as a couple for 12 months or longer before she got her PR because then she would have been required to add you to her PR application as a common law.

You can not apply inland at xmas if you are leaving Canada. It's a requirement of inland that you stay in Canada during the processing.

You can apply outland no matter where you are. Having applied will not affect your visit visa you already got.
 
Actually we didnt live together and she didnt mention me in her application .

So as u said marrying her on xmas will not affect my entry to canada at any time ?

Mr Leon do u advice me to file for inland application or from outland ?

And if i get married and declare my marriage in canada and then file from outland would that cause any problems for me in coming back to canada on april to live with her permanently until i get my PR ?

Getting married will not affect your already existing visit visa. However, you have no right to live in Canada permanently until you get your PR so when you enter Canada, it must be clear at all times that until you get your PR, you are only visiting.

Inland and outland both have their pro's and con's. Inland means you must reside in Canada during the application process so you could not apply until April and then if you apply for an open work permit at the same time, you might get it, if everything goes well, in 10-11 months. That means staying in Canada without working for that long but you would be with your spouse.

Outland processing time depends on your visa office. You have to find the visa office that processes for your home country and check their processing times here: http://www.cic.gc.ca/english/information/times/perm/fc-spouses.asp If you find that your home country has an extremely long processing time, you might be better off doing inland. Otherwise, you might be better off doing outland because you can apply as soon as you get married and you can be outside Canada or visiting Canada during the process which also means that if you get bored sitting at home waiting for your application or money gets tight, you can go back to your home country and work while you wait. This would not be possible with inland.

If you apply outland and go to Canada to "visit" because you are technically not allowed to move to Canada to live there while you are not yet a PR and only on visit visa, you have the same options for a work permit as any other foreigner that is in Canada on a visit visa. That is that if you want to work, you would first need an employer to apply for your LMO (labour market opinion), proving that they have advertised the job and are paying market wage but can not find any qualified Canadian workers. If the employer gets the LMO, you would be able to apply for a work permit. The process of getting an LMO can easily take 2-3 months. The process of finding an employer who is willing to apply for an LMO for you can easily take longer than that.
