Hi ASIVAD ANAC and all fellows,
First, just briefly described my situation.
I have arrested record 3 years by police and I was in charged with Assaulting. Actually I didn't and this is a mistake. Finally, I was given by STAY OF PROCEEDING BY PROSECUTOR in the court final diposition. My lawyer told me that I will have no crime record, since I am not CONVICTED and not Guilty. Recently, I got the PNP nomination and apply PR under EXPRESS ENTRY. On Jan/25, I got the request for RCMP report from CIC and I ordered it on the same day. I have been waited for 1 month and still didn't get the rcmp report. I went go the fingerprint center again, and I was been told that my fingerprints and photo taken at the time when I arrested was still in the RCMP NATIONAL DATABASE. The process time for RCMP report will take more than 120 days. Now, I realized that I got very serious trouble. CIC only give me 60 days(March/25,2016) deadline to submit RCMP report.
I have following questions and Concerns:
1. Close to the submitting deadline, I will submit the LOE from myself giving the reason why I can not submit the RCMP report on time and also I will attached a copy of receipt showing I have ordered on the same day I get request and ask to give me an extension. In the letter,Can I request for 90 days extension or just not mention any days? Usually, how many days CIC will give to first extension? If I did get the first extension and my report still didn't come and do I have a chance to have second extension or I will be REJECTED?
2. Do I need to also submit the LOE from my criminal lawyer and also the court documents which showing I was not convicted in a crime or offence in that arrested incident?
3.In the SCHEDULE A which I submitted, there is a question like:" Have you ever convicted a crime or offence without a Pardon has been granted", I answered "NO". I have checked with the Criminal Lawyer and my immigration agent before answering this question. At that time, I also thought I should answer No, since I have not convicted to a crime. So in the LOE, do I need to explain this question since I just realized I have fingerprinted record in an offence???
By the way, 3 year ago when I was arrested AND I were applying the PGWP at the same time, I guess CIC knows that I was in charge and only issued me a 1-month PGWP. After I sent the copy of the court of proceedings, CIC re-issued a 3-year PGWP finally.
I think CIC may will reject by application at the deadline(March/25) if I didn't submit RMCP report, but I will try my best to keep a hope on my appilication.
