Thank you so much for your response. I'm drafting an intention of letter and will get it reviewed by an immigration attorney. I would like to get it reviewed by you as well if you're comfortable with it.

I don't have a QC DL, however, I do have QC provincial card. I'm not sure if leasing an apartment in Ontario will help me get BOWP. I can work remotely if need be.

Regarding WP extension in QC - without CSQ, my employer will have to get CAQ and LMIA. They are fine with it but I am not because in my express entry application, I'm trying to show intentions to reside outside Quebec whereas work permit extension through LMIA and CAQ negates my intention to leave Quebec. I will have two contradicting applications in the system which can lead to refusal of PR. Do you have any thoughts about this?
I cannot review individual documents. If you already have an attorney, rely on him.

Hi guys,

I am a january 2019 AOR. I just got off the phone with IRCC agent and he told me the status of my file.

Eligibility: not started
Medicals: passed
Criminality: passed
Security: not started

Now my question is can criminality pass before eligibility is even started? I am a bit confused as I havent read anything like this before on this forum. My file is being proceesed at sysney, nova scotia. Guidance would be appreciated thanks
YEs, criminality an R10 happen at the same time. Also, your file is at CIO (central intake office) where thr R10 and criminality is done.

The eligibility happens at CPC.

Thank you so much for your reply. I have two more questions. 1. Should we send the LOE beforehand or later if they ask for it. 2. what explanation can be written that will look genuine to IRCC?
The LoE has to be a part of your application. As regards explanation, explain why you did not mention it before. When you sign a form, you sign it claiming that all the information in the form is true and accurate.

Hi @legalfalcon,
HI, I am new in these forum , curious to know about due date in Gcms due date.
Does it mean that CIC will process my application after due date. I am OID applicant already completed my 12 month after application submission .I have not recieved my Medical request yet.
Need help please give me some input.
Due date is a system generated date, on which date the officer working on your file is reminded of the pending file. It has no significance.

Thanks @legalfalcon , my case is bit different, my canadian child is born after between ITA and e-APR. I received ITA, then child born, still I haven't submitted e-APR. I am in process to fill the forms after I received ITA (bottom table with 'continue'/'decline' button PR application XX days left).

The question is:

  • OPTION A: Should I add my newborn canadian (as Unaccompanying PR child form) by 'Modify Family Information' Button on top?
  • OPTION B: Should I ONLY declare newborn canadian in 'immediate family members' table in Family subsection of Personal Details Section?
  • OPTION C: I do OPTION B, and while submitting my eAPR, I submit also the IMM4506 in LOE section. But I believe IMM4506 is similar to immediate family members table.
Kindly advice, which OPTION, I should follow, really confused after reading conflicting opinions on forum, some ppl added as unaccompanying, some not.

You will have to add a child who is Canadian born in the application and also file his Canadian birth certificate.

Thanks, so you mean I should go for option A:
  • OPTION A: add my newborn canadian (as Unaccompanying PR child form) by 'Modify Family Information' Button on top?
  • and add birth certificate.
Right???

IRCC states:

Minimum work experience requirement
The applicant must have accumulated at least one year of continuous full-time (or the equivalent in part-time) paid work experience in the occupation identified in their application for permanent residence as their primary occupation. In calculating this period of work experience, the occupation must be listed in skill type 0 (Managerial occupations), skill level A (Professional occupations) or skill level B (Technical occupations and skilled trades) of the National Occupational Classification (NOC) 2016 [R75(2)(a)].

The applicant’s skilled work experience must also

  • have occurred within the ten years preceding the date of their application for permanent residence; and
  • not be in an occupation that has been designated as a restricted occupation.
Note: At the time of publication, no occupations were designated as restricted.

In addition, during that period of employment, the applicant must have

  • performed the actions described in the lead statement for the occupation as set out in the occupational description of the NOC [R75(2)(b)]; and
  • performed a substantial number of the main duties, including all of the essential duties, of the occupation as set out in the occupational description of the NOC [R75(2)(c)].
Note: The applicant does not need to demonstrate that they meet the “employment requirements” listed in the NOC occupational description.

You do not have to meet the educational requirements. What is important is that your job duties should substantially match those of the NOC selected.
Dear @legalfalcon,

Could you please offer suggestion regarding the definition of essential duties, and the difference between essential and main duties for IRCC (or Canadian law)? Thank you!

I was informed that if i order gcms notes, it would delay my file, as the officer will require to work upon my file as well as submit report which would slow down progress.

Is that true?

Completely false. The GCMS notes are requested and released under the Access to Information Act, where as the application is processed under the Immigration and Refugee Protection Act, which are entirely two different laws, and are delat by two different departments of IRCC. IRCC has a dedicated department for Access to Information and Privacy requests, which deals with the GCMS notes request.

Your notes look good. The Review required is for the funds and your file is awaiting an officer's review. As soon as the officer review's your file, the eligibility will be passed and it will move ahead.

I do not see any concerns.

Dear @legalfalcon,

Could you please offer suggestion regarding the definition of essential duties, and the difference between essential and main duties for IRCC (or Canadian law)? Thank you!
Each NO has some essential duties, which form the core of that occupation. When your reference letter is reviewed, the essential duties should be there and a substantial (75% or more) number of job duties, should match the job duties of the NOC selected. For essential duties, see the lead statement of the NOC.
