Dear Legalfalcon,

Requesting your advice on the following matter:

I am an FSW applicant, AOR is 8 April 2017, Medical passed and BGIP1 on 9 June 2017, BGNA since 14 June 2017.

Yesterday, I found out from an IRCC support centre agent that my file was being processed by Visa Office in Singapore. The agent could not confirm the date when the file had been transferred to Singapore as the file notes did not contain an email confirming the receipt by Visa Office in Singapore. She mentioned that IRCC usually receives 'Confirmation of receipt' email when files sent to visa offices outside Canada are received by those offices.

The agent informed that my file was last reviewed in Canada on 18 July 2017 and it must have been sent to Singapore shortly afterwards. She advised that there is no need for me to reach out to Visa Office in Singapore as my application is still within the normal processing time lines. Further to this, I was told that I have passed both R10 check and criminality check and everything looks good on my file.

Based on the above, kindly advise the best course of action:

- shall I wait until the end of 6 months from AOR (8 April 2017) before contacting CIC?
No need to worry, things seem to going fine. If you would like to know what stage your application is at, you can order GCMS notes. They are the best way to know what is happening.

- Shall I send an email to Visa Office either in Canada or in Singapore to get clarification regarding the file location or where it is being processed?
Not required. Its an internal movement and everything will go smooth. You GCMS notes will also indicate the same.

- If yes, shall I mention the call to IRCC support centre in that email?

I noticed 5 points reduction in my crs score from 438 to 433. The decline was in the Human Capital Age. I had my birthday in between ITA and Application submission. I read on CIC website that post ITA they do not consider the age change if it is due to birthday and hence no change in points? Am i correct?

How can i resolve this?
As per IRCC policy this is what happens -

An applicant may have a birthday after they receive an ITA but before they submit their e-APR. Their change in age may lower their CRS score below the lowest score in the round of invitations. It may also result in the applicant no longer meeting the minimum requirements of the FSWC and, consequently, no longer meeting the MEC, resulting in a refusal based on section A11.2.

When a change in age results in the candidate no longer meeting the MEC or having their recalculated CRS points score fall below the lowest points score in that round of invitations, officers should consider applying the public policy to exempt applicants for permanent residence from certain age-based requirements between invitation to apply and application, based on section A25.2. This consideration can result in an exemption from the refusal of an application under section A11.2.

This public policy also grants an exemption to applicants who may be refused for failing to meet FSWC program requirements when their birthday occurs between the ITA and e-APR.



If your case falls in the above and still there is a score deduction, then you should immediately raise a CSE and inform them. If after the lower score you are still over the MEC and the CRS, there is nothing to worry.

Very strange. It's explicitly mentioned on CIC website that birthday between ITA and e-APR will not impact CRS. How did you get to know about this?
It does not say that it will not impact CRS, the policy only states that When a change in age results in the candidate no longer meeting the MEC or having their recalculated CRS points score fall below the lowest points score in that round of invitations, officers should consider applying the public policy to exempt applicants for permanent residence from certain age-based requirements between invitation to apply and application, based on section A25.2. This consideration can result in an exemption from the refusal of an application under section A11.2.

It is not mandatory, but discretionary and many factors are taken into consideration when this is applied..

Dear @legalfalcon ,

Please guide me on the following issue:

I received PPR a few days ago. My wife is a medical doctor and her name includes Dr in her passport. Since it is a title and not her name I did not include the Dr title in the application. The CIC status page also lists her name without the Dr title. Also I had included an affidavit with our application mentioning that Dr is a title which she attained after getting her medical degree and also listed a nickname she has.

Now after attaining PPR and while filling out the Appendix B I am now confused as to whether include the Dr title or exclude it when filling out the name and also writing on her photo. Your help regarding this would be much appreciated.
Only include the name, not the title. Most passports will not allow the title, if your country does, then do not include it.

Hi,
Me and my spouse both are Indian citizen but our son is Canadian as he was born during our visit to Canada. While filling an application after receiving ITA, i have mentioned he is Canada citizen and residing in India. Now when i moved to next page - checklist, here, CIC is asking fees for his PR. But my understanding is, it shouldnt be. Please correct me.

You should not be asked to pay for your Canadian child's PR fee. You can raise a technical query and get this sorted out.

Hi,
In checklist, It asks for multiple document in Passport/Travel documents. I have only mentioned 1 passport. I am not sure, why it is asking multiple documents.
Is it because i was in Canada, so do i need to upload WP as well ?

Also i was in other countries but for those, do i need to upload as well ?

Multiple documents is the generic term used as many people have passports and identity cards form their countries. If you only have a passport, just scan and upload it, all pages. If you have an online passport with visas or arrival and departure stamps, then that should be included too.

I am into my ITA stage, I have got a reference letter from my past employer where I worked for almost 3 years.
I have everything covered in the letter except all my designations. it only shows my last working designation.

I was Assistant Systems Engineer - Trainee --> Assistant Systems Engineer -->Systems Engineer.
But the letter shows only my Last designation i.e. Systems Engineer

Can you suggest if this is a problem? or what can I do in this case so it won't cause any troubles to my profile.

As per IRCC, the reference letter should mention all designations you have held. If your reference letter does not mention that, then you can include it in the LoE, and add any supporting documents, like any communication you received from work with your designation, or a promotion letter. Nothing to be too concerned, but clarifying this is much better.

S 26 and s22 are the same corresponding section which you see in the s15 / 16 of the access to information act. The sections are exactly the same but will differ depending whether you ordered the notes under the privacy act of access to information act.

Did the email come for the following addresses - IRCC.CPCO-FinalRequest-CTDO-DemandeFinale.IRCC@cic.gc.ca or a similar one, then yes this is the PPR.
Yes.

Citizens of visa free country do not need to send their passports. But follow the instructions in the PPR, and if they are not applicable to you, send an email and clarify.

You can request that your partner is in Netherland and would like to submit the passport there, IRCC will send you the instructions for it.

Thanks a lot! I've sent an email to IRCC. I'll also call them on Monday and see if I can convince them it's a mistake and accept photocopies instead.

There has been no change post rprf mail on 1st may. Few months ago due to technical glitch the additional documents section showed 'additional docs required' but no mail or message ever came. I wrote to CIC couple of times but nothing from their end.

It's been 177 days post AOR for us, can you please help me understand
1. Why is it taking them so long (28 April is more than 3.5 months)
2. What do they do in BG IP2?

Would really appreciate your input on this. Thank you very much

I ordered it on 17th July and they asked for new consent form to be filled as it had only my digital signature. Do you know from prior cases how long does it take to receive the notes?

This is because you signed the consent form online as in on a computer using a software like Acrobat PDF or Preview on Mac. Just gat a new consent form fill it, take a print, sign it with pen and send it again.

When you electronically sign a document, you are issued a key, and an audit log from there that is verified, but I doubt that is the case, so just follows the above.

You should only notify of address change after you leave the country and not in anticipation. In an eventuality that you get PPR right when you are about to move, you can inform IRCC and they will change your VO and send you new instructions for the country you will move to.

It was not in anticipation but I was planning to move from my current job. Since the PR is being processed, kinda wanted it not to suffer coz of the move. So I can move and notify them after that regardless of a PPR or not
