Hello @legalfalcon.
My AOR is 10th September and MEP 7th October, but my background check says it has not started. Biometrics got done on 12th. Is it normal for Background check to be slow? I have applied under FSW-0.
Does this imply that I haven't met eligibility yet?
Should I ask my consultant to raise a webform to know what going on?
What could be the right time to order GCMS notes in this case?
Thanks in advance.

@legalfalcon, we appreciate all the advice and counsel you have been giving us.

Please I have a question.
I have 95% of my POF in my account for over a year. Also, the account has been very active too.
After I got my ITA, I deposited the remaining 5% into the account.
Please will this affect my application?, because I read somewhere that the full sum.has to be in your account for 6 months prior to submission.

The BGC is a generic terms for criminality and security. Usually criminality is passed early in the process, unless biometrics or a PCC is pending.

Security only starts after eligibility is passed. Check the GCMS notes to ensure that eligibility is passed.

See my previous post on eligibility at #2,521

To read on security and security screening manual, see https://bit.ly/3lMufJd

When to order GCMS notes:

The GCMS refer to the programmed called Global Case Management System (GCMS) used by IRCC that holds the entire processing record of your application, including the the notes pertaining to eligibility by an officer evaluating your file.

All applications go through the following stages:

R10
Medicals
Criminality
Eligibility
Security

R10 or the completeness check is the first stage of the processing, wherein it is verified that your application is complete and all documents are submitted. Filing a complete application is the responsibility of the application, and if a document is missing, a reason and an exemption request should be filed.

If an application is incomplete, it will be rejected. R10 usually happens within 30-45 days of filing your application, around the time when medicals are passed. The exact date will be available in your GCMS notes.

There is no point requesting GCMS notes at this stage, since if your application is incomplete, it will be rejected anyway, and for the medicals, the MyCIC account does inform you of when your meds are passed.

GCMS notes become important only for the eligibility stage, which does not start until 3-4 months. Eligibility takes place in 2 stages. First a case assistant or an analyst will review and make a recommendation. This is then reviewed by an officer who makes the final decision on the eligibility. Since each document you submitted has to be reviewed twice, this is the most time consuming stage.

Only for this stage are the GCMS notes relevant.

While GCMS is a great tool, use it sparingly and only after 3-4 months have expired.

You have to meet the 6 months average balance requirement to show that the fund in your account is yours and not borrowed. If you recently submitted 5% of the funds, then you may not be able to meet the requirement, but you can show the source of funds and explain in Loe.

To read on PoF generally see https://bit.ly/2Ji5GpF

@legalfalcon If I'm working for a government department as an education policy/research officer, do I need to list my employment as government? This is in the personal history question where they ask: List any government positions (such as civil servant, police officer, employee in a security organization) applicant has held at any time.

Usually this questions is for if you are in a position where you are a part of the government decision making. However, it is better to answer yes, and explain it in LoE.

Usually those who are in the armed forces, military, research, judiciary, para military, police etc. will have a stringent security and may be asked for additional documents.

Hi @legalfalcon I have another question  I visited my husband in Canada last year in December on a temporary Visa for 30 days. I was living in the apartment that his company had provided for him. Should I mention that address in my address history too? Or just let it be because I was basically on a holiday?

I stayed in Canada too on a temporary visa for 2.5 months twice. I didn't put it in my address history, but I added it in my personal history because it was quite some time.

Thanks a lot @legalfalcon. Should I raise a webform to inquire about my progress? It's almost three months now.

If you were on holiday, and you never changed your address, since you were here temporarily, you do not need to list it in your address history.
