Hi

One of my relative lives in Canada for some period and each year he file return and go back to home country .he filed income tax return and CRA send him a questionnare regarding the some information about childrens and submission of papers related to school and family doctor registration from 2011 to date.
He would like to ask you clarification about following questions:
1. could he replies to questionnare
2. is it possible CRA claim the amount paid to him for childrens and tax back from him since from his landing or from assessment period
3. is it possible he send letter to CRA for moving to home country and will contact as he come back from home country.During this period CRA will wait or contact some other persons to locate that fellow.

1. He needs to answer the questionnaire and submit the requested docs.

2. Yes, if has illegally claimed the benefit and any tax breaks, then the CRA will most definitely go after him for the money. They can also assess him penalties for doing this.

3. No, they won't wait. They can go into his bank account to take the money, garnish his wages, place a lien on any property in Canada etc. He needs to sort it out quickly.

further to query if he leave the country and go back to home country without paying any amount of child benefits and GST and HST to CRA because he has no more funds for payment of such amount with penality & interest then in this situation what will be the action of canadian government and other question is that could he again apply for the immigartion after some time.

Fraudulently claiming money from CRA is a crime, so they could start criminal proceedings against him, which could definitely affect any immigration efforts later on. His info will also be kept on file, so if he does manage to return to Canada and start working, they will take any owed money from him.

IF THAT FELLOW VOLUNTARILY DISCLOSE THAT HE WAS OUTSIDE CANADA THEN CRA IMPOSE ANY PENALITY AND INTEREST OR NOT OR ONLY ASK THEM TO REFUND THE PRINCIPAL AMOUNT.IN SUCH SITUATION IS CRA GO BACK BEYOND THE ASSESSMENT PERIOD OR ONLY ASK FOR ASSESSMENT PERIOD.KINDLY GUIDE US ACCORDINGLY IN THE MATTER.

You should really just contact the CRA.

CRA is very efficient -- that same convenience that lets you pay government fees at the bank makes it simple for them to do the reverse -- one time our travelling caused them to pay us a month or two of benefits that we didn't deserve, and they asked for it back within five months. There were no hard feelings or threats, they didn't expect us to understand how they calculate residency, and we had always kept them up to date on our address; there's no way for you to deal with them through this forum, go down to Service Canada and clear things up.

Basically he is getting two benefits , Job and enjoying his family overseas and benefits from Canada, One way please otherwise troubles
