I previously applied for a T13 LMIA-exempt employer-specific work permit from inside Canada while holding visitor status. Unfortunately, my application was refused because the officer determined that I was not eligible to apply from within Canada and that the application should have been submitted as an outside-Canada work permit application.
Following the refusal, my employer remained supportive and paid a new employer compliance fee so that I could reapply correctly.
I am now preparing to submit a new T13 LMIA-exempt work permit application as an outside-Canada application, even though I am currently physically present in Canada as a visitor. I understand that if the application is approved, I need to leave Canada and re-enter in order to have the work permit issued.
Has anyone been in a similar situation—where an initial T13 work permit application submitted from inside Canada was refused because it should have been an outside-Canada application, and then successfully reapplied as an outside-Canada application while still remaining in Canada as a visitor? If so, was your application approved, and how did the process work for you?
