Super visa re-entry from US

Hi there,

I just want to inquire about the rules and regulation for exiting and re-entering the country if you have a Super visa.

· My mother hold a super visa that expires in 2019 and she arrived here on November 11th 2015 and her two years maximum length of stay is coming up soon. I would like to know if we can exit her in the USA instead of her going back to the Philippines because she doesn’t have anybody to stay with back home?

· If we are allowed to exit and re-enter her to and from the USA, what are the criteria? Do we need to stay in the US for a specific length of time?


By the way, we exited Canada August 19, 2017 and came back August 20, 2017 with my mother because she also has a US tourist visa and when we came back the border officer didn’t stamp her passport. Isn’t that considered an exit or does she have to be out of the country for a specific length of time? Is there a minimum length of days to be out of the country for it to be considered an exit?

When she goes out of the country these are the scenarios:

- She is let in, with a new entry date and full 2-year stay.
- She is let in, honouring her initial entry date (no extra time given).
- She is let in, with a new entry date but with a shorter period (from 2 weeks to 6 months).
- She is refused entry.

What you are trying to do is to skip the line of regular people extending their TRV. This is not well seen by immigration, it is considered an abuse of the law, basically "trying to play it smart".

In this last attempt your mother was on option 2 (let in, honouring her initial entry date (no extra time given)). Usually that is what happens with visits to the USA.

Extend her stay, that is the correct way to do what you are trying to do.

There are no published requirements.

What exactly are you asking? How soon someone can re-enter after visiting the first time?

Yes - you have to re-do the entire application and apply again from scratch.
