My parent came to Canada on a Super Visa issued in 2022 but their passport was expiring in August 2023. Unbeknown to me at the time, the visa expires alongside the passport it is stamped in. They entered Canada in July 2023 at which time this issue was raised at immigration.

At the time re-application for a Super visa entailed a 1 year long wait in my home country and since i am the only child (Canadian citizen) and my parent is unable to survive by themselves, i opted to file a H&C application. The application was declined after 2 years. Their current stay is valid for 5 years as confirmed via cic.

With this backdrop, Super visa applications processing time has now dropped to approx. 4 months in my home country. My question is that if we go back and re-apply for Super Visa, will this declined H&C application have any negative impact? Is there anything else in this application that i have to be mindful of? Thank you
 
It could impact it because it shows that they are not genuine visitors but planning to say indefinitely in Canada.
Thank you. Is there any way that i can debunk that assumption? My parent is 78 years old, we are not interested in a PR but for them but to have the liberty to come and go as desired. Super visa terms with a 4mos processing time meets our needs.

Also in the H&C application which i filed, i narrated the same reason. I paid for a 10 year visa and now had to deal with a significantly reduced duration and processing time of a year

Nothing to debunk or explain. When she applies then she passes the medical, gets health insurance, and submits her application. You say not interested in PR but that is what H&C is and she applied and was refused.

Why in gods name would you file and HC application ?
Those are for EXTENUATING unique situations.
Your situation is not unique. You moved to Canada , your parent didn’t
And of course applying for HC will be looked at with the Supervisa application. They aren’t genuine visitors
Lots of senior parents live by themselves. Your situation once again is not unique
Why people don’t think about their parents when they immigrate is ridiculous.
Saying they can’t survive is being dramatic. There country will have to take care of them or you leave to go stay with them

A visa doesn’t necessary expire by a passport expiry date but a visa is only a travel document so not sure how this is really relevant. Was there a date written in their passport upon entry which would have indicated the maximum length of their visit? They have already been visiting for 3 years. Were they able to renew their passport from Canada? As others have said you don’t apply for H&C within a year of entering Canada if you are not interested in PR. Lying that they weren’t trying to secure PR won’t help your case. For the highest chance of securing another supervisa your parent should spend quite a lot of time in their home country before applying for another supervisa so there is much more significant proof that she has reestablished her ties to her home country and has a plan for her return to her home country after her visit and growing old there. Even with a supervisa they may not be able to enter Canada due to the H&C. If already 78 even if they obtained a supervisa and could visit Canada again she would still need to qualify and purchase supervisa insurance every year. Most seniors will eventually not be unable to secure supervisa insurance (especially at an affordable cost) and once you have many preexisting conditions many won’t be covered for their most likely emergency medical issues.
