Yeah I know sisters can’t sponsor sisters but if the nurse sponsors her parents(who are undoc. in US) Lisa goes with them since she is under 22. If the sponsorship is approved will the parents have to go to Canada as well? Can Lisa go alone? Maybe w some other adult
It's a parent sponsorship program so yes one parent would have to go. The issue is when they all leave the US they have a 10 year ban. Have you made sure the nurse meets LICO for 3 years? She would only be able to apply in 2020 and it could take until 2021 to get accepted. She also not even get a spot for 2020.
The situation is tough because if Lisa attempts to establish ties to India t improve her chances at getting a study permit she won't be able to return to the US and see her parents for potentially a very long time. I would make sure she is looking into a plan B. Studying in the US at a state school or community college might be a better option. She can apply from the US for a Canadian study permit but applicants living in a 3rd country usually struggle to get in. Having family in Canada already while having parents living illegally in the US makes it really tough to show that you plan to return to India after your studies.

It is a parent and grandparent sponsorship program. Parents are the primary applicants. Dependents under 22 are allowed to accompany them as a bonus.
At least one of her parents (the one who is the primary applicant) will have to come to Canada and "land" to become a PR in order for Lisa to be able to come to Canada as a PR. Lisa cannot become a PR without the primary applicant traveling to Canada either first or along with her. Assuming the parent who is the primary applicant is in the US without authorization as well, they will automatically be banned from the US for 10 years as soon as they leave and will not be able to return to the US for at least a decade. So at least one of the parents must be prepared to leave the US along with Lisa. She cannot come alone.
Thank u for your input! So let’s say Lisa and her parents do end up getting their sponsorship approved and she ends up going with her mother. Can they apply for a waiver to enter America after staying in Canada for a while?
They should assume a waiver will not be possible. They should assume they will have to remain outside of the US for a minimum of 10 years.
Sorry should have made it clear that parent would have to stay due to ban. Thought that was a given for all of them.
Also will have to factor in age. Looks like the nurse will only be able to attempt to apply in 2020 and it is still unclear if she meets LICO for all those years. Lisa can still attempt a study permit but the ties to home country issue will continue to be an issue.
