I am currently on a student visa which will expire end June 2017. But I was kicked out of school in February for poor attendance (have a small child). I presently have a spousal sponsorship application in process. Do you think if I apply for an open work permit at this stage it maybe granted as I want to maintain legal status as I wait on a decision on my application. Or my best best is to apply for visitor extension?

Unless you applied for PR inland and included an OWP with your inland application, you're already in Canada without legal status. Study permits are automatically canceled once you're out of school for more than 90 days. You need to start by applying to restore your status to visitor.
