Hi. I just finished school and have a spouse who is a permanent resident. I already applied for PR and have the AOR but I'm confused about how to apply for open work permit since I'm technically still a student (my study permit expires in 3 months). When I choose student on the portal, it takes me to PGWP which isn't what I want to apply for. I'm wondering if I can choose visitor in order to get the open work permit option? Any help is appreciated.

If you need to work right now, you need to apply for PGWP. If you don't, you can apply for BOWP if you passed a completeness check stage in your PR application.

I'm referring to SOWP application. My spouse a permanent resident and sponsoring me.

Technically just an OWP and not a SOWP. SOWPs apply in instances where the primary partner is in Canada temporarily on a study permit or work permit.

I'm sure someone will be able to assist. Just give it some time for the right people to read your message.

Doesn't matter as long as the OP is in Canada and has AOR.
Yes, I'm in Canada. Still a student graduating this month (study permit expires in the next three months). My spouse and I are married and she's a permanent resident. I have AOR and she's sponsoring me.

So the sponsorship application has been submitted and you received AOR with application number of that sponsorship application?

(your initial post about PR application and SOWP was a bit confusing)

You will be applying for a new open work permit.

That's correct. Sorry about the confusion. Will I be applying for the open work permit as a student? The application portal asks if you are a student or a visitor, and I'm not exactly sure what to choose there. Thank you for the help. I appreciate it

Did you follow the instruction in this page? There are specific instructions for OWP under family/spousal sponsorship. (not SOWP)

Find the section about "How to fill out the application form". Specially about box 1 and box 4 in one of the forms.

Can you share a reference? I see that only inland applications are eligible for a work permit. Here is https://www.canada.ca/en/immigratio...mmon-law-partner-canada-open-work-permit.html

The thing is that you can apply outland or inland even if you are in Canada. These are two different processes.

The rules changed a couple of years ago to allow outland applicants to apply for an OWP provided they are physically in Canada and have AOR. This is a well established rule now and lots here have done just that. I'll see if I can find a link later of the rules change being announced. But again, this isn't new and is well known.

It definitely makes sense. But I like having a solid proof as an argument. I will research as well. Thank you.
