student visa and PR in canada advise

My child PR status is lost for not meeting minimum days stay requirement. Do not have any PR files or PR card now.

If we apply for student visa for higher studies in canada, will there be any issue in getting Student visa and also during POE in canada , because holding PR status some time back.

If eligible, can my child apply for fresh PR again in future after studies are completed ?

Please suggest.

First what is your status in Canada ?

You cannot apply for a study permit for your child given they will still be a PR whether they have a PR card or not given PR status never expires and can only be renounced or revoked. To apply for a study permit would need to renounce PR first which should be last resort.

If your child arrives at POE having not met residency obligation then chances are they will get reported leading to PR status being revoked. By the way if your child is flying to Canada they cannot board a plane without a PR card or PRTD. If the child was removed from the country with parents so had no choice there is possibility of applying for a PRTD under H&C.

If your child is not reported at the border then they could stay for 2 years without leaving and reset their residency obligation. Hence the question on your status in the country given as a minor then some responsible adult would need to be responsible.

If your child renounces their PR status it would have no effect on a future PR application as long as they qualify at the time.

Please advise how to - renounce PR first and How much time it takes.
can we apply for student visa only after getting confirmation about - renounce PR status.
can we renounce PR status while living outside canada.

suggest the best and faster approach.
