hey guys and gals so i am pulling my hair out with stress as many of you no doubt have done at some stage in this process as well. I was given some very poor information from a CIC person when i called asking about the ETA as i was going out of the country and i asked while i was on the phone if i was eligible to extend my travel work permit and she said yes! obviously not the case so i have been rushing to get my PR application done through my common law partner i havnt submitted it yet still waiting on my police clearance from Australia. i will be submitting a application to change conditions etc etc form with it. i have 2 questions:

1: what box do i tick for question 3 an initial work permit or work permit with different employer, work permit with same employer, restoration of status as a worker or temporary resident permit.

i have an open work permit now that expires 29th of October so i am very worried that it wont be processed before my current work permit expires.
that leads me to the next question.

2. if my work permit expires before i get anything back about having my permit extended as i have read it can take more than 4 months can i go to the US or another country then re-enter canada on a visitor visa?

i have ticked the box an initial work permit or work permit with different employer but if i my permit expires would i not have to have checked restoration of status as a worker?

and if my current permit expires in October then alot of my answers in the application will be different or does it not matter if it is what my status was at the time of submitting.

any help or advice would be greatly appreciated

APPLY OUTLAND. Sydney is a very fast office and you will most likely be a PR by the end of the year.

You can apply outland from within Canada while living/working there. I am in Canada right now and just applied for PR outland and I already have a decision made. I'm very glad I didn't apply inland.

Doesn't matter. You can be IN Canada while an otland app processes.

interviews are very rare. don't base the decision on an interview. Syndey is one of the fastest offices for processing. DO NOT APPLY INLAND! it is highly likely you would be totally approved for pr within the same amount of time or LESS than it would take for your OWP to be extended/received.

You have pretty much no chance of being called for an interview, so don't factor that into your decision.
 
for inland, if you apply for a new work permit before your current one expires you are covered by implied status until they process it
 
For any work permit, if you apply for an extension at least 30 days before it expires you are on implied status until decision is made, and even if it's not approved (the WP) they give you 90 days to apply for restoration of status, which in turn takes a few months too. So don't worry! Apply for a work permit (I'd say - an extension with the same employer if it is the same employer - there is another question on that form asking you about your current status and you will need to give your OWP number anyway, so they'll figure out you were here on OWP) and then apply for PR, outland. It's quicker and if you are given a WP you just wait for the PR; if they refuse your WP application (which I think is quite unlikely, unless you need LMIA and don't have it yet - it takes a few months for the employer to get so your permit might expire until then), so even if they refuse it you';; have 90 days to restore status (which you can restore as visitor, you will have applied for PR by then so, again, you would have a fair chance that they'll give you your visitor status as you're waiting for your PR decision) and at any rate, 90 days for applying and then the processing time for the status restoration will give you enough time to get PR easily. So apply for your WP extension, apply outland for PR, and take a deep breath :) good luck!
 
Has the IEC working visa thing been resolved? Last time I checked there was a debate on this, because the IEC visa is non-renewable so it would not give implied status.

Regardless, take Canuck-in-UK's advice and apply OUTLAND. There is a good chance it will be done before your current work permit expires.

Bad advice. OP doesn't qualify for a work permit if applying outland and cannot work on Implied Status anyways because it's an IEC permit.

If the outland PR process looks like it will take longer than the current work permit validity, OP should apply to change conditions and extend the stay as a visitor.

Thanks for pointing this out canuck - i thought she implied she had the question of whether she can or cannot extend iec resolved. But, wouldn't it be possible for her to apply for a new wp, closed, just happening to be with the employer she's with? Unless time is ticking, then indeed changing status for visitor is the way to go.

A closed work permit requires an LMIA.
