Hi Guys

My wife received a refusal letter stating that She has not satisfied the visa officer that she will come back to India.

Shall we go for the Visitor visa?

This time, we will show the family ties like the property documents etc that are on her name.........

will this work?

Thank you.

There's absolutely nothing stopping you applying however they will have the first refusal on file and that will in some way have a bearing on this decision - ie why all of a sudden are the circumstances so different?

If you want her to visit you need to have a watertight application.

or apply the WP again .....and show property docs + bank balances in india etc........

will it work?

Yep apply again as WP... Good luck!!

Think about it from the prespective of the visa officer, imagine you are in his or her shoes. Your job is to make sure that people do not permanently move to the country (unless their moving via PR etc).

When a spouse is also residing abroad (such as you are) it's hard for the immigration officer to imagine that a spouse would leave them and return to his/her home country.

Consider also that the spouse applied for a work permit, and now all of a sudden is a tourist? I don't know many tourists like that. It seems obvious that you and your spouse want to move to Canada, what use is showing properties and bank balances going to do? It doesn't prove for a second that your spouse will return.

I mean yes, you can apply again but I don't see how or why it would be approved.

I will apply WP again very soon .....as I will also show that I will come back to INdia after my Wp expires......and show the strong family and economic ties for her........

Then will see what happens.......

It makes more sense to apply for a WP again, but only if there have been significant changes in her circumstances since her last application. Can she find an employer willing to apply for a LMO? Does she have any work experience from your home country? If she has never worked, it could be a tall order to satisfy a visa officer that she will be able to find employment in Canada.

She will get a job letter in India....which will state her economic ties with India...moreover, as my WP expires early 2014, I will also show my willingness to go back to India....
