Hi there if anyone could please answer my query would really helpful I tried finding looking in the forum but really can't figure it Actually my partner is going Canada for her studies she and I met in New Zealand we got married there stayed together for 6months after then she has to leave the New Zealand because she got sick and health issues and her family situations she is now in England she is a British and I am from India ,she is applying for her further studies Canada my question was as she wants me to come with her to Canada I don't know which visa should I apply Also we stayed together only for 6months after marriage will that be problem although it's gonna be one year since we got married in New Zealand what should I be doing in this situation should i let her go to Canada for studies and then I should go there on visitor visa and then apply from Canada for open work permit I am not getting any idea how to figure it out I have been in New Zealand from last 3years and I am currently also living and working here if anyone could please suggest me out my this puzzled situations would be really helpful thanks
 
You can go with her on spouse open work permit. You have to attach your marriage certificate, bills, lease as many documents you can to prove that your relation is genuine. Then a strong SOP. Ties to home country so to convince officer that you will leave Canada after your wife's study. Funds to support both of you. These are few of the documents you will have to attach additional to your wife's study permit application checklist.

Hi Navprateek thanks for replying me appreciated i wanted to ask one thing more thing that i have have reading in UBC website saying that most of the people do that after their spouse land in Canada on study permit their other half arrive in visitor visa and then they apply for open work work after landing their ,do you think is it better and secure way of doing and get visa , also should i let my partner get her student visa first then i apply for open work permit since she is i England and i am in New Zealand where do you think i should process my file after she gets her student visa from New Zealand or from India i am afraid applying from India could be a problem reason the rejections rate and all that since i have been living in New Zealand last three years what do think i should be doing please if you suggest me anything thanks

Thanks Navprateek, although i visited my partner in U.K as well i went to see her in U.K on a family visitor visa will that going to make any difference to my application my apologizes i didn't get that part in which you said your partner got open work permit so was it like this you arrived ahead then he applied after you were granted student visa on bases of yours thanks
 
Our story is like: We both were in Canada on study permit. My husband came in 2010 and I came in 2012. Then due to some reasons he had to go back to India and his study permit was about expire, because of certain circumstances we were not able to get an extension before he left. After 6 months of his stay in India we got married in Sept and by then I had work permit on me and met the minimum requirement to apply for SOWP application. Then same year after 3 months of our marriage we applied for his file. We attached a lot of documents to support our case, and did hire a lawyer for all this. He was back in Canada within 2 months.
 
hey Navprateek i talked few of the lawyers in Canada they said theirs no assuriety although we will try our best but no one can guarantee of visa also i have ones got my student visa rejection from Canada the reason was choosing the wrong course its so complicated our situation
 
Navprateek did you guys hired lawyer from Canada what would you suggest in my situation the best way should be i am not getting any clue of what should i do my partner is English she can easily get any visa she has been in Canada before also , she was also having her international experience visa for Canada of 3 years visa since thats quite similar to working holiday one she didn't used it as she wanted both of us fly together for Canada but unfortunately am not eligible for that visa because only certain countries get that visa and U.k is top most of them so i got stuck and because of me she is taking studies so that i can go with her now again more obstacles
 
No lawyer can give you the guaranty on approvals. Ours said the same thing. He did put efforts and got us through. Now you already has a rejection on your file. This may affect your case. You can try no one is holding you - a strong SOP can turn the tables around :)
 
Do you think that if she goes in Canada for her studies and i go as a visitor showing a strong proof of companies sponsored visa letter and holiday leave and return flight ticket when i apply will that going to make a difference in immigration officer mind thinking that ill return after i visit her
 
Hey Navprateek should I hire lawyer from Canada but I really don't anyonecwjose good and whose not wgatvshould I be doing in such situations I am getting confused here please what's your perspective
