Hi everyone,

I filled up the questionnaire on CIC website and it at the end of it below are the document checklist I got

Application for Work Permit Made Outside of Canada (IMM1295)
Family Information Form (IMM5707)
Passport Instructions
Proof of medical exam Instructions
Digital photo Instructions
Proof of Relationship


I never had the IMM5257_B form at the end of the questionnaire :( . Am I missing something while answering the questions? If I used this reference code, I'd have to apply for the TRV separately :(

Please help me on this.

HI ,

I am doing this process for my husband through immigration lawyers.

These are the documents i gave them. I did not give any other additional documents for my husband's SOWP.

List of documents submitted:
1. IMM 1295 WP from outside canada
2. IMM5645 Family info
3. Income Tax
4. Police clearance
5. Reference letter from employer
6. Pay stub
7. Digital Photo
8. Wife's Work Permit
9. Birth Certificate
10. Marriage Certificate
11. UG Documents (Marksheet,Degree)
12. Passport Copy
13. Medical was not upfront

Thank you. So would you be applying for the Visa after the work permit is approved?
I was told that we would be applying for both the visa and work permit at the same time.
Can you shed some light on it? Thank you.

Imm5257B is not mandatory..its additional document..in this document..they jsut ask passport number nd name . so, don't worry.. u will be fine.

That's really weird. You should get that under "additional documents" section. I just checked my wife's online application and I have all three applications " IM 1295, 5707 and 5257_B. I would say you cross check if you have answered the right questionnaires.

You will apply both at a same time and the TRV form is the one with 5257_B code.

This is correct, but fees can be same for different visas. Just make sure you have answered all required questions correctly.

Hi Fkl and Seniors,

I have two OWP rejections previously and I am trying to apply for the third time.My wife has recently got PGWP approved for 3 years.I was advised before by Fkl that there is no issue once my wife gets her PGWP and a job offer under NOC category to apply for the OWP. My doubt is that ,whether the offer letter should mention the LMIA on it or it can be an offer letter just explaining the NOC Code and duties and responsibilities,Kindly reply ..thank you

LMIA - not required for SOWP, it's a requirement for EE PR. Also if you have multiple rejections, I would ask you to wait for three pay-stubs at-least and then show as much proof as possible regarding your wedding, engagement and all that along with some pics. The more you provide the better it is as it never hurts to throw some additional papers in your application. Good luck.

LMIA is not a requirement as already mentioned, even for EE PR. Its just that if you have an LMIA based job, you get extra points.

However, having an LMIA makes it crystal clear what NOC you have (since it was already evaluated and stated in LMIA) and there are noworries for CIC regarding a job being skilled (only NOC 0, A or B).

Note that a PGWP holder needs to have a skilled job (NOC 0, A or B) in order to apply for a spousal open work permit.

So your experience / offer letter should unmistakably prove that your spouse has a SKILLED job. This means it needs enough detail of duties, required qualifications that the employee has etc.

Again, the rest really depends upon reasons of refusals in the past and its hard to comment generically.
