What if I apply for an immigrant's visa through FSW with dependents, (common law partner and our daughter) and my common law partner decides not to come with us. Will I have a problem? Will the family visa be forfeited?

Even if ur common law partner does not want to join u even then u should provide his/her details in dependent form.
If u get PR, its at the discretion of common law partner to join u or not. Only thing that would happen is that ur common law partner PR would expire after 5 years.
 
Have you gained any required points from inclusion of the common law spouse in order to get the 67 points to qualify for FSW?
 
My overall points is 75. He gave me 5 points for his IELTS
 
I think you have to inform CIC if your status changes. If you and your cl spouse split up you should let them know, otherwise, if it is just a matter of your spouse choosing to come later to fulfill their PR then it won't matter.
