Spouse and common law sponsorship Canadian citizen sponsoring UK citizen

My spouse and common law sponsor is currently under progress.. I am UK citizen and my husband is a Canadian citizen who is my sponsor. I was not aware that i was only able to stay in Canada for six months but i have been here more than a year. My son was born in the UK however is a Canadian citizen. I am not working nor studying here. Please could you advice if i will be able to apply for an extension of my time here until i received my PR status in Canada. Immigration are aware that im residing in Canada . Please can someone advice me on this matter and whether i should go back to UK until the sponsorship decision has been made.

If your and your son's visitor status expired over 6 months ago, I don't believe that it's possible to apply for an extension.

Sorry. You said "my son", and I wasn't aware that he was your partner's son as well.

I don't see how you can, but perhaps I'm mistaken...which I hope I am!

Not to add to your angst, but...
If you applied with an Inland application (sounds like you did), this would not prevent you from being approved, as legal status is no longer required (as of Feb 2005) but...if you are in Canada without status, it's unclear what the new policy is with CBSA regarding this issue.

Prior to November 2011, CBSA had an `Administrative Deferral of Removal' in place for those that had an Inland application submitted to CIC. No idea what their revised policy is now.

I see that you've modified your original post.

Going back to the UK now will kill your Inland application as it requires the applicant to remain in Canada for the duration of the `ride'.
However, if you just recently applied, that could be beneficial in two ways:

1. Leaving Canada on your own would in essence resolve your overstay.

2. Applying Outland will likely be a faster process for you.

Or...you could remain and hope that you reach stage 1 approval (AIP), which would then give you some breathing room with CBSA.

I made the application in July 2012 however my son was born in the UK in 2012. I received an email from the immigration that we have past the first stage that my husband is eligible to sponsor me ( Sponsor application status ) Decision Made however the PR Application is still in progress.
End of last year 2013, they required me to send UK police report _ submitted and i submitted my medical examination from Canada at the same time as the one i sent on prev year has expired.

Im just slightly skeptical as to why it is taking so long for them to make a decision as my application is a very straight forward.

You might try posting this in the Inland 2012 thread, but it sounds like you are very close to becoming a permanent resident of Canada!!

Received an update today from LDNIMMIGRATION stating they have received my medical certificate and my file is currently waiting for office review.

Does anyone know how long or roughly this process may take?
