Dear All,

I hold a post graduate work permit in Canada and working in an enterprise earning more than $33,000 a year.
I already filed for myself and my wife's (she is in India) PR on the basis of arranged employment.
Since the whole process will take 18 months to finish, i applied for my wife's dependent visitor visa in New Delhi.I hired a lawyer in Ontario to do the paperwork.
They rejected it saying :
You have not satisfied me saying that you will leave Canada after your tenure.
1.Your family ties ---------(Had submitted all details like marriage certificate)
2.You financial funds-------(she is working in India for an MNC as a senior Software developer)
3.Your travel history-------(She had traveled to Holland for onsite and returned back on time)

Me and my lawyer has decided to reapply again as ours is a genuine case where in she has to return to India with in 2 months as we have a leave letter from her company.
I am planning to attach the below mentioned copies for her next application:


-Refusal Letter copy
-Her Visa Photos
-Her passport
-Last 6 month salary slip of Her
-Last 6 months bank statement
-Fixed deopsit's reciepts
-A Letter from bank saying the fixed deposit is still active
- Her financial documents
-marriage photo with family
-Leave letter from office
-lease agreement of mine
-Invitation letter
A covering letter by her saying
-Reason for previous business visit to holland
-Previous companies experience letter from which she travelled to holland
-Proof of properties in her name
-Husbands-Passport,Visa Copy,Offer letter,Work permit,PR application details

I request advise to know if i am moving in the right direction.She was refused visa 3 days back.We are applying immediately as her leave is running out.
Please let me know if there is anything i can do to add more value to her application.

You should provide proof that she is still employed in India (the salary slips only prove she was employed in the past - not that she is still employed now). You should also include a letter from her employer confirming she is on an approved leave/vacation and stating when she is going to be returning to work after her visit.

I will add that also saying that she is currently employed.

Do you think all the other documents that i am presenting will be an overkill ?

If you feel i need to add anymore documents or remove some please let me know.
Also what kind of visa do u think i should be applying for her now like a visitors or dependent ?

Also do you think reapplying so fast is going to have any negative effects on her application.

You probably wonder why they refused on basis of travel history when your wife has been to Holland and back. My understanding of the travel history is that when it is for business it isn't as compelling as if it was for pleasure. Not only is it the issue of returning to the home country before the expiry of the visa, but pleasure travel shows that one is established, they have enough money to afford holidays abroad. You could elaborate on the Holland trip by stating why she went if it proves your wife has a responsible job/important position and increases her ties to home.
 
Family ties - you reside in Canada, so really her ties to home country are not strong enough especially if you don't have young dependant kids. Generally, couples like to be in one place and it's more likely that she would relocate to Canada than the other way around. If she gets here, what will make her leave? The VO is probably thinking along these lines.

Is she just coming to visit or do you plan to extend her stay afterwards? The only reason I ask is, you hold a work permit and if your job is skilled (NOC O, A or B), your wife is eligible for a spousal work permit. Any reason you are not exploring this option?

Re-applying without significant changes in her situation will likely yield the same result.
 
Explore dual intent. If you have submitted your PR application with your wife as dependent, then her intention is to stay in Canada which is contrary to application of the TRV. Attach a letter explaining she's coming for a visit and is going to return to India once the allowed visit is over because she does not want to jeopardize the on going application by overstaying her allowed visit.
