I am a Canadian citizen and I want to get married to someone who has lived in the USA for about 10 years (overstayed). Now he is back home in home country and he has no criminal record. I am planning on sponsoring him once we get married so I’m just wondering if his overstay in America will pose any problems when he is interviewed for the sponsorship. And if so, will I need a certain type of lawyer or a immigration consult for this situation?

He overstayed in USA, not Canada.....and won't be a barrier for sponsorship......and you don't need a lawyer or a immigration consult for this overstay in USA issue........when you complete the sponsorship application, be very honest when providing information.......don't lie or hide any information, especially when completing IMM5669 (Schedule A) form.

Your spousal sponsorship will be approved based on the proof and genuineness of your marriage/relationship.
