Hello,
  • I am US citizen married to a Canadian citizen.
  • I am currently a temporary resident in Canada with a work permit expiring on August 1.
  • I'm waiting to receive a marriage certificate before applying for spousal sponsorship and an Open work permit, and I'm not sure how long this will take.
  • I am also anticipating a potential job offer for a new job in mid- to late-August.
I have a few questions (apologies if any of these have been answered previously -- I would appreciate any relevant links).

1. If the PR application is received before my work permit expires Aug 1, my understanding is that I may continue working under Implied Status. However, what will happen if I get a job offer for a new job? Will I then have to apply for a new work permit at a port of entry?

2. If the PR application is *not* received before my work permit expires Aug 1, will I still be granted Implied Status? If I stay in Canada after Aug 1 under these conditions, will I be in violation of my temporary resident status?

1. If you hold a PGWP now, then you can switch employers while waiting for the OWP. If you hold a closed work permit now (employer specific), you'll need to wait until you have the approved OWP before you can switch jobs (or obtain a closed work permit tied to your new employer).
2. No implied status. You will be out of status as of the date your work permit expires unless you convert your status to visitor visa. Either way, you'll need to stop working as of Aug 1.
 
Thank you! I hold a closed work permit right now. In the event that I cannot submit the PR application by Aug 1, can I still apply inland as a visitor and hold visitor status for >6 months while the application is being processed?

Yes, you can but you cannot work while waiting for OWP.
