Spousal Sponsorship - Financial Concerns

Hi everyone,

I am an Australian on my second WHP Visa and my partner is Canadian. She spent all of last year at University becoming an elementary school teacher and is now a TOC just like me. I've been working as a TOC and part time teacher for the past year. Now I'm not sure what the specific financial considerations are for her to sponsor me and with no income from the last financial year we are afraid if we apply via this route she would not be accepted as a sponsor...

This seems to be our only hurdle, as we would be able to prove our relationship and my Canadian immersion easily. If we could find clarification on this, it would allow us to move forward with the application.

If anyone has any advice please let us know as we are considering a lawyer (yet I'm not convinced a lawyer would be able to tell us anything more on this topic anyway...)

The only considerations are that the sponsor NOT be on any social assistance in the previous year, there is NO income requirement. You don't need a lawyer. Especially seeing as though you have very good command of the English language.

Not sure how our thread got attached to the other one (my forum inexperience probably caused it to happen) but thanks for your information. Hopefully I can convince the missus that we wont need to waste money on a lawyer. Anything else you can add is much welcomed.

Having no income last year will not be a problem. Just include a letter in the application detailing your circumstances and include any income statements and bank statements that prove that you have the means to sustain yourselves financially. If she hasn't filed for taxes last year she doesn't even need to bother with the Option C requirement.

Here's what your document checklist says:
PROOF OF INCOME FOR SPONSOR (this section applied only to sponsors who are not residents of Quebec)

1. Attached the following :
An original Option C printout of your last Notice of Assessment for the most recent taxation year along with printouts of all income slips (e.g. T4, T4E, T5 and T5007). To obtain these printouts free-of-charge from the Canada Revenue Agency, call 1 800 959-8281.
If you do not provide this printout, provide an explanation on a separate sheet of paper.
And yes, convince your wife not to throw your money away :)

I was also wondering about this. I will send in my application next month, but with processing taking a year (or more due to the strike) what happens if I get pregnant and have a kid before we are approved? Anyone know how this will affect our application if it would happen?

According to Section 133 of the Regulations:

Exception to minimum necessary income

(4) Paragraph (1)(j) does not apply if the sponsored person is
(a) the sponsor's spouse, common-law partner or conjugal partner and has no dependent children;
(b) the sponsor's spouse, common-law partner or conjugal partner and has a dependent child who has no dependent children; or
(c) a dependent child of the sponsor who has no dependent children or a person referred to in paragraph 117(1)(g)

So if the sponsored spouse has a dependent child who has no children of their own, or the sponsor gives birth to a child during the sponsorship process, there is still no requirement to meet the minimum necessary income level.
