Hello Friends,

I have a few questions on which I need some guidance. I could not any thread in the forum relating to my situation. If this has already been discussed then kindly point me to that thread.

I am a Canadian citizen working US. I just got married and my wife is an Indian citizen working in Singapore. She will be leaving her job in a month and joining me in US on a TD visa. With this visa she can stay with me as along as I have a work permit. Now, I want to apply for her PR to Canada and have the following questions:
1) I want to apply from outside Canada for her. Can we apply for her from US (while she is a visitor) or she can only apply for it from India?
2) If we apply from the US which region specific requirements/rules apply to her: India or US?
3) If there is an interview, will it be conducted in US or does she have to go back to India?

Please help to clarify my doubts. Thank You.
 
Was your wife admitted to the US for at least a year?

If she is admitted to the US on a visa that is good for a year or more, she can apply through the US. She can also apply through India if she wants. If the visa she enters the US on is good for less than a year, she will have to apply through India.
She does not need to be in India to apply through the Indian visa office - she can stay with you in the US while her visa is being processed in India.
She does not need to have been in the US for a year before she applies - her visa just has to be good for a year or more.
2) If we apply from the US which region specific requirements/rules apply to her: India or US?
The US. You always follow the region specific requirements for the region you are applying from. If there are some requirements you can't fulfill because of differences in documents between countries, attach a letter explaining why anything is missing.
In my opinion, even though it is not required, it is better to include anything the Indian checklist requires, in addition to what the US checklist requires - just in case the visa officer decides to send the application to India after all, which they can do.
3) If there is an interview, will it be conducted in US or does she have to go back to India?
The interview will be in the US if you apply through the US, and in India if you apply through India.
The visa office in New Delhi is faster, on average, than the one in Buffalo. But the New Delhi office asks for the passport very early in processing, and you are not supposed to send Indian passports through the mail. So your wife might have to go back to India to submit her passport, and wait there if you choose India as the processing office.

My wife has a 10 year multiple entry visa to the US. Does that work for the 1 year requirement?

So can we apply from US within a week of her getting here or do we have to wait for sometime?

I could be wrong - but I don't think the 10 year multiple entry visa will count.

The rule states that someone has to be legally admitted to the US for at least a year to qualify to have their application processed through Buffalo. The 10 year multiple only allows her to visit for six months at a time, right?

Hopefully others will comment.

We'll just apply from New Delhi. Does the process always result in an interview of the sponsored person? What about the medical: Does it have to be done from India itself if one applies from New Delhi?

No - an interview isn't always required. Make sure your application is complete (i.e. no missing police checks or forms or signatures) and provide as much documentation to support the authenticity of your relationship as you can - and hopefully you can avoid the interview.

You can do the medical anywhere in the world as long as it's performed by one of the DMPs (designated medical professionals) listed on the CIC site. No need to go to India for the medical.
 
This process really frightens me, mostly because of the many horror stories i hear from other people.
I'm 30 yr old female, cdn citizen, living in toronto and would like to sponsor my husband in 2 months time from Sri Lanka. Are there any tips, advice you can all share with me before submitting the application to avoid any delays, frustrations etc. I thought its better to hear from experienced individuals rather than solely relying on other website information. any help would be appreciated.
