Hi there,

My daughter lived in Canada for 8 years and has, now, obtained her PR. She is, however, back with me in Dubai. I would like to apply for immigration through sponsorship by her and I have no clue where to start. Can anybody please help with information to get going for 2018? Thanks in advance!!:)

First of all, she needs to be living in Canada in order to sponsor you. Secondly, she must be making enough income from a job in Canada to meet the low income cut off and she must have three years of income in a row to qualify.

Has she been with you in Dubai for a while? Is she living there with you? Or is she working full time in Canada and only went to Dubai on a short vacation? If she's not working in Canada, she will need to return to Canada and work there for three years (in a job that meets the income requirements) before she can qualify to sponsor you.

Thanks a lot for your reply Scylla! She worked in Canada for 3 years after graduating from UFT. She returned to Dubai 2 years ago and is living with me. She is working here but still paying her taxes there.

Regarding salary, she is well qualified and meets the income requirements

Only income earned in Canada counts for LICO. And it needs to be income from the 3 years prior to applying. Income earned in Dubai won't be counted. She will also need to maintain that income level during the application. And she still needs to be in Canada to apply and stay during in Canada during the application process.

Unfortunately she doesn't meet the income requirements, since the income will only count if sponsor is physically residing in Canada while it's earned. Income earned while living outside Canada, is not eligible.

So your daughter will need to move back to Canada, then work 3 years making income over the minimum amount. The she will need to enter the lottery for parents sponsorship, and hope she's one of the ones selected. Suffice to say, with meeting Canadian income and unknown chance to be selected in the lottery, it may be a very long wait before she would be able to submit a sponsorship app for you.

Note also if your daughter is not living with a Canadian spouse, she needs to watch her residency obligation. Once she is physically outside Canada 3 years (out of 5), she is in violation of the RO and would be subject to having her PR status revoked. If she's been with you for past 2 years, then she needs to return back to Canada within next 1 year, and stay in Canada at least 2 straight years.
