Sponsoring sibling - mom "unfit"?

Hi guys,

I'm canadian, and my husband is a permanent resident from the Philippines. (I sponsored him).

His little brother is only 9 years old. His father passed away, and his mom is now a single mother. My husband has one older brother, but he's not really in the picture.

We'd love to sponsor the little brother who really regards my husband as a father. Their mom does not work, and refuses to work. She is happy relying on the money we send her weekly. After 2 days, she uses almost all of it up and keeps bugging us for more. I don't even know how she manages to spend so much money in such little time! Ugh! (Can you sense my anger???). She's really hardly worked a day in her life - save for maybe a year which was over probably 3 decades ago.

Anyway what should we do in this circumstance? Will his mom have to give up her parental rights? Will she have to be sponsored along with the boy? Since he is a minor, will he be able to sign all of the necessary paperwork? CAN we even sponsor him?

The only possible way is to sponsor the mom, and have brother included as a dependent.

You can't sponsor brother independently. Even if you legally adopted him, it would just be seen as an adoption of convenience so he can immigrate to Canada, and would most likely be rejected.

there's no way for your husband to only sponsor his brother since he has a spouse in canada. likewise, having the mother give up parental rights, giving them to your husband and attempting to sponsor him will not work. a) there was no mention of this dependant on his own PR application, b) his brother was most likely listed on his PR app as his brother, so CIC will assume your husband is only adopting his brother in order for him to immigrate to canada. CIC does not look too kindly on situations like that, and the last thing you want is your husband to be accused of misrepresentation by CIC. that will cause a lot more issues for sure.

Not that I'm planning anything evil, but just more out of curiosity - What happens if she passes away? Her son will be left an orphan????

i think if the boy is left an orphan, that's a completely different scenario than if his mom gives up parental rights so he can immigrate to canada. also, in the eyes of the Canadian government, he DOES have other family in his home country, so even if the mother dies, sponsorship still may not be an option.

parental sponsorship takes a LONG time, i think it's currently taking 4-5 years for approval.

Since parental sponsorship takes such a long time, it might be better for you to put the application in now. I'd imagine it would be quite difficult for you and your family having your mother living here with you, but for your brother's sake it might be the better thing to do. You will have peace of mind knowing that your brother is well taken care of by you, getting a good education, and loved. Also, since from your initial post it sounds like your mother is carelessly spending the money you send, it could be a better financial situation. Your mum won't just have money handed to her. You will give her the food, shelter, etc. she needs rather than her just wasting it on something that is not a necessity.

I think it would definitely be something to think about (sponsoring your mother and also your brother as her dependent). Does your mother have any illnesses? She will have to be able to pass a medical exam to prove that she won't put a big strain on the medical system.
